Used car faulty but garage refusing responsibilty

    I've checked the MOT and it had no advisories. I am not expecting them to do a full service, just fix the faulty car they sold me.

    Brakes don't last forever, they are maintainable items, like tyres etc.
    Same with the service.

    It's not a biggie as in we're not talking about major failures like a turbo or clutch, but general components that do wear down- especially at 50k miles.

    Did you not inspect the car first?
    Most discs can be seen through even a steel wheel if you remove the trim with the aid of a torch.

    The price of £900 or £50 isn't what I am querying here, I am asking if it is the dealers responsibility and how to get the car fixed without having to pay yet more money.

    No, brakes do not last forever, but I'm fairly sure it takes more than 3 weeks for them to become totally worn.

    Do NOT waste more time trying to talk to the garage because if you go outside the 28 days then you've lost the chance.

    If VOSA re-inspect and agree that it shouldn't have passed then your MOT is still valid (it doesn't invalidate the pass result) but you'll have to get the repairs (including anything else they might find) done.

    You'll be in a very good position to claim the full costs of the repairs off the garage if that happens, or to reject the car (if you prefer) because it was sold in an unroadworthy condition.

    Well if the mileage was advertised has having less miles than it actually has, all the other issues become irrelevant as the car was miss-sold in the first place.

    You could go to trading standards with its as there may be a criminal act to investigate. Or the seller may prefer for you to reject the car and give you a full refund.

    Brakes don't go from an MOT pass with no advisories (minimum 1.5mm pad thickness and would normally be advised if getting anywhere near that) to grinding noises from worn out pads in 3 weeks!

    The smoke may well be an MOT issue as well depending just how bad it is, not to mention how far out the emissions are likely to be if it's smoking like that.

    I think the mileage is the main issue here. There appears to be a significant discrepancy in the reading now to that recorded in the MOT history. Although clocking itself is not illegal, selling a vehicle which has been clocked is unless the seller makes clear that the mileage is not 'accurate'.

    If the OP was not made aware that the mileage is 'iffy' then the car has been miss-sold and therefore can be rejected under the SOGA. The other issues become irrelevant.

    Sorry, but if you perhaps read the posts properly before commenting you would have read the the odometer reads just under 29000, it is only is you look at previous MOTs you see the difference.
