item not as described... hwo to handle it with low feedback seller

I bought a designer leather chair for my wifes birthday which arrived this morning, the chair was part of a magazine shoot (apparently) and it did say in the listing that it would need a light clean. As I say chair arrived this morning and after opening the boxes it was clear they were not packaged correctly the stainless steel feet look as if they have broken through the box at some stage in transit and been scraped, the leather is very dirty which we can clean. but there are a few scuffs on the leather itself that are never going to come out, the leather straps that the cushions rests on also has some damage to one of them.
the advertised leather was white, which the chair seems to be however the stool looks ivory, and seeing them together its clear there not the same colour.
i've sent a mail to the guy and hes replied this morning saying hes sorry and he will check the insurance cover and did i sign for them as being damaged.
i replied no i didn't sign for them damaged because i couldn't see the damage through the boxes and the feet were wrapped around with a polystyrene wrapping type stuff rather than bubble wrap.
i paid for it via paypal and haven't raised a claim as yet, not sure what to do on that side of things....
any ideas on what to do next, and don't really want to stump up the postage to return them to him, it cost me 50.00 just to get them sent to me via tnt.
the guy has 100% feedback (all previous sales have been in the hundreds of pounds) and he has 6 trades under his belt.

we have also noticed that the frame turns from stainless steel to chromed along the frame and some of the legs, its quite noticeable to us and not sure if he even offered a partial refund i would be happy accepting it now. Not sure where i stand in if i return it should i be refunded for the original postage.

I would give the seller a couple of days to check the insurance his end. Follow it up on Monday and if there's nothing to be done put in a claim.
Ultimately the Seller has mis sold the item and has not provided sufficient packaging.0 -

yeah i was thinking the same, just worried that if i don't put a claim in straight away that he could draw the money out and walk away and not be bothered.
i dont have much faith in paypal only use them because the payment is instant. I know if i state that the item is not as described then, they will want me to return it and i will pay for the postage back to them which wont be refunded (i'm assuming) its a put a real dampener on the wifes birthday present.... i've had a parcel go missing that i';ve sent out and now this i'm really starting to think that you may pay more in the high steet but you obviously look at the item beforehand and have someone you can talk to face to face if things go wrong.Listen to what people say, but watch what people what people do!!0 -
From what you say he replied with he seems okay. He apologised, said he's check the insurance and asked if you recorded it as damaged. Seems relatively professional to me. I'd give it a few days.
If you do feel uncomfortable and want to put in a claim then do so but it could end up making things worse and you could rub them up the wrong way if they're genuine0 -

yeah i agree with that, hes since came back to me and said hes sorry for the inconvenience and that he will speak to his boss. I dont want to raise the claim and like you say make them agitated, its me being impatient and i should give them the benefit of the doubt, just with all the horror stories i dont want to sit back and wait and them be told i should have done this and that at the start of the problem.
fingers crossed his boss will either offer a decent partial refund or agree to accept it back and arrange the courier himself back to them.

just go to ebay and the request cintact info link on the left you need to pop the item number in the box they will email it to you . it doesnt matter if he takes money out of paypal you can still pop in a claim0

thanks, just has a phone number as contact information rather than an address aswell. i'll try to give them a call shortly. just noticed that they had some items with days to go and now there are no items at all. i'm starting to get bad vibes about this one.Listen to what people say, but watch what people what people do!!0 -
I have just looked at the listing and the 2 photo's although the same design look different one seems more sat in. The chair and stool looks like a matching colour. I would also politely point out the discrepancies in what you have received. At least they have 100% positive feedback and a phone call may be a good option to find out where you stand. As if it was me I would want this sorted out ASAP when paying that sort of money.0

thanks, yeah i know what you mean about the photos but in actual daylight the cushion is an ivory colour where the chair is ice white. to be honest if they had the problems down in the description i still may have bid (but not nearly as much) but they have actually stated that the chair has not been sat on which may have been the case but someone has not treated the chair very good. And really when i thought i was bidding on a nearly new chair, the current state it is in is that its second hand at best. certain things can be repaired on the leather but the side of the frame i'm not sure sure about and just taking into account the hassle factor, it may be better just to send it back.Listen to what people say, but watch what people what people do!!0 -
I would phone them on the number you acquired, see what they have to say. If you have to send back, use a courier with proof of delivery. Photograph the areas of damage (always a good idea for reference). Hopefully they would pay full or part return postage.0
