    I would phone them on the number you acquired, see what they have to say. If you have to send back, use a courier with proof of delivery. Photograph the areas of damage (always a good idea for reference). Hopefully they would pay full or part return postage.

    tried the number and its just ringing out so will try later today, i've also sent them another message asking how he got on with his boss. I'll hopefully get them to collect using and paying for the courier themselves. (don't think its fair that i have to pay to return the item back to them)

    well as i thought the seller promised me that he spoke to his boss who was going to take it up with the courier firm. ive not heard a word back since Tuesday, raised a item not as described with paypal and apparently the seller has replied saying he doesn't agree ( after he sent me a mail saying that his boss would do a partial refund - how much was i thinking) case is under review now, not sure whether to neg him now or wait, hes not listed anything else,

    couple of questions, i have a telephone no but no address (is there somewhere i can stick the number in online to get an address going to pay the company bloke a visit with a large van.

    also is it worth me talking to my credit card company, will they be able to do a chargeback? I'm assuming hes took the money out of paypal account and will just re register another one>

    can try it with the cc company - probably best bet.

    thanks, not sure what the best way to go about it, if i say to them i have got the item but its faulty they may want me to return it to the guy (and i've got no return address) or if i say i havent got it, they may be abel to get in contact with him via paypal and then he provides a tracking number and they will see i'm lying and then will lose there trust.

  • if they only have 6 previous feedback, then paypal wouldnt have offered you the £500 buyer protection, and you may well not have any protection at all through paypal.

    i dont want to jump the gun, but waiting a few days may enable the seller to complete the transfer of funds to their bank account so paypal can no longer get their hands on it.

    If you funded the payment with a credit card, get in touch with them and ask if they'll perform a chargeback for you, based on goods being fulty and seller not being too helpful. thats the way i would proceed.

    thanks ( i didnt realise you had to have a certain amount of feedback to be covered by the buyer protection scheme). I thought paypal could still obtain the money from someones bank account if there was a dispute?

    i waited on the advice at the start of the thread the seller originally was saying that his boss was open to a partial refund and how much did i want etc. i've also raised a ebay dispute but i suppose i'd only get just under 100 back from them if it works.

    i will speak to the credit card company on monday, at the end of the day i cant return it, i have no return address the seller refuses all communication so i'm a bit stuck on that front. the credit card is goldfish and they have been good on previous occasions.

    if the £500 buyer protection is not offered then what you get depends on what the seller has/hasn't in their account

    they have now amended the buyer protection scheme, it seems to be offering £150 worth of protection on some items on which the seller hasn't reached the required rating of 50 stars

    Just tell the cc company that its a faulty item and the seller is refusing to let you return it and you don't have a return address.

  • there is an arguement to say that if the person selling on ebay is a trader that the distance selling regulations apply which would give you an automatic 7 day right to reject subject to some exceptions . If item cost over £100 and paid by CC poss argue = liabilty under section 75 of the consumer credit act.
    Seek some guidance from Consumer direct see http://www.consumerdirect.gov.uk/
    once past the garish colour scheme worth a look
