cancelled french villa - owner threatening legal action

Bob,
Don't think I am being ridiculous at all. That is certainly how you come across. I have gone to great lengths to explain my situation but you have accused me of trying to "cheat" the french villa owner out of his money, you have gone back through my old posts to try and find information on my mum, and you seem to be more than happy to let me know that I probably won't be able to claim on my insurance. Not sure what other conclusion I could really come to.

This policy will not cover any claims for
Cancellation that arise directly or indirectly from
a pre-existing medical condition of:
A non-travelling immediate relative;
A travelling companion who is not
insured under this policy;
A person with whom you intend to stay
whilst on your trip;
Health conditions
This insurance has conditions that are about your health and the
health of other people who may not be travelling with you, but
who you are depending on for the trip. We do not cover medical
problems that you or they had before the cover started.
In this case the OP's mother (87) has just spend a year in hospital and care home according to another post.
What does that bit mean?0 -
Your first post started,
Hi there,
I wonder if anyone can advise me.
As I said just because you don't like the advice does not mean it is wrong or right. I hope the insurance does pay out, I hope that you are not too much out of pocket and that the villa owner gets the money due to him. However to not pay someone after entering into a contract to do so which you did is not on in my opinion.0 -
Yes Bob, I came on here for advice. I am happy to be advised by people who know better than me and if that advice is not want to hear, ok I am not going to be happy but I will accept it. However I am not really interested in your opinions or judgements on me.

Ah yea, but I get the OPs point about the way you've gone about it.0 -
Anyway can we just leave it there. I am sure we have all got better things to be doing. I know I have. I do really appreciate all the advice. We will run it past our travel insurers and take it from there. When all this is resolved I will come back on here and post the outcome.
Good health to you all.

I DO hope that the insurance route works for you. Good luck.
One thought I have had, is that since your mother has been under fairly constant medical care for so long and her condition was still undiagnosed that might be one tack to take with the insurance company because it makes it 100% certain that you could not have known about this condition.0 -

You're not coming across as an honourable person; more a keyboard warrior with the social skills of a brick to the face.
The OP has at no point attempted to dodge anything or wiggle out of it, he has asked if he is required to pay. At every opportunity you have attempted to twist his words to mean things they cannot reasonably be taken to mean. It'd be pretty pathetic if it was your contract he was questioning; but being this petulant about a third party issue is something else.
Kudos to dave for his responses, personally you'd have been on ignore about two posts in. I hope his mum's last few weeks go as well as possible.Having a signature removed for mentioning the removal of a previous signature. Blackwhite bellyfeel double plus good...0 -
Sorry to read of the situation you are in OP, thoughts are with you at this difficult time. Is your mum likely to be in palliative care at the point you are due to go on holiday or, and please don't think me insensitive here, but could she come with you for a few days in the sun.
When you post on a forum asking for advice from people you are asking for their expertise and opinion. I have read everything that Bob The Saver (in his own special way
) is just making sure that you have answers to all the questions that the insurance company will ask you. I think, even if you do not agree with the way he raises these points, you would do well to take something from the questions he has asked.
I hope that you get the answers that you want from posting on here.“Listen earnestly to anything your children want to tell you, no matter what. If you don't listen eagerly to the little stuff when they are little, they won't tell you the big stuff when they are big, because to them all of it has always been big stuff.”0 -

Many of my neighbours have Villas and Gites and I can tell you they are having a very tight time often losing money.
My point was that if you enter into a contract you should stick to your side of it. The villa owner has no connection with the sad reasons behind the OP's situation and just wants what is their due.
The reasons behind the situation are very sad but legally and morally no different from if the OP had just changed his mind as far as the villa owner is concerned, they might well be fighting to hold on to their property in the current climate in France with house prices dropping like a stone.0
