ebay not sticking by own policies

The thing is - saying a phone is faulty is not the same as being blocked.
Lots of TV's etc are listed that do not work. Buyer takes risk and tries to repair. They should NOT be allowed to return it if they cannot fix it.
But this phone may have been blocked - and thats an whole different matter. Maybe thats what Ebay think?
As already stated - PAYPAL will have to pay the money back - and its them that will set the deby collectors on you.0 -

The fact that I listed the defect and he is still able to return it due to not as described is the most frustrating part. But it looks like I'm not going to have much choice but to start again. Bit wont sell it on eBay as this could happen again and again.
If eBay took a bit of time to look at the case properly and the messages back and forward between myself and the buyer they would know what they have decided to do is wrong. But they don't seem to want to know and I keep getting the same templated emails from different members of staff as if they don't keep up with the progression of the case before replying.
Its the reason I won't use eBay after this experience.0 -

Lol that is quite funny...
I have just this second received a telephone call from the resolution team basically saying in ALL these cases they ask the buyer to return the item. Once I have it I can then appeal on the grounds that either it has damage that it wasn't sent with or the reason the are returning was correctly described... So basically all I can do is wait until the item is returned then put an appeal in. Not holding much hope though.0 -
KevinM2k, you just need to accept that Ebay made a lousy decision when you receive the phone back in the condition you sent it, then refund the buyer.
Make sure you check it's the same phone that has been sent back.
The buyer has to pay for returned track postage.
Given you can re-sell the phone, then you only lose out on the cost of the initial postage, which is what the buyer will lose out on too. You will then have the phone back and can re-sell it.
Closing your Paypal account is a really bad idea. Is it worth risking debt collectors and a bad credit score (which will effect you getting loans, a mortgage etc...) just for the sake of losing out on the cost of postage?!

I have decided im going to see how the next couple of days pan out, but as you say i'm more than likely inclined to give a full refund and move on.
I have also decided that when I get the phone back, i'm going to get it fixed then sell it as a working phone which will probably put me up anyways. (Sell on Gumtree though not ebay)
I closed my paypal account as a preventative measure so ebay cannot automatically take the cash out of my bank account whilst the account is in dispute, what is weird is that when the dispute first happened my account went -200, but when I closed it it was already back to 0.
If I lose the appeal I put in then i'll make payment another way, if i win the appeal then the money wont have come out of my account anyways. I don't mind paypal too much even they are related to ebay, but ebay have really gone down in my estimations.
I'll try and update with what happened in this case, but I just despise companies who try to change the rules to suit themselves and feel quite strongly about it so much that I physically don't want to pay them out of principle. Plus if no one stood up to these companies, they'd all get away with murder.

How did you list the phone as 'used' or 'for parts not working'?
If you listed it as 'used' then I agree with ebay even if you put the details in the description the listing was wrong.
Ive brought a couple of phones via ebay and get fed up with amount of sellers listing a phone as used then stating in the description that it does not work - there is a separate category for that.0 -

Firstly I am no phone engineer and as far as I knew 'no service' could mean it was locked to a network I didn't have so I didn't know for certain that it didn't work only that it didn't work on o2. (this is a true reflection of what would happen if it was simlocked to a different network) - so 'not working' didn't seem right.
Secondly I do think ebay need another category, 'Parts or Not Working' insinuates that it is useless and needs throwing away and whatever is wrong with it cannot be rectified which I disagreed with.
However if there was a category for 'Used - with Defects' I would of chose that, also someone did bid within the first 5 minutes of the auction being on and that stops you being able to change any information about the auction.
Regardless of that, the policy STILL states that no refund will be available if the defect is clearly described in the auction - so either way they still should of stood by this.
I did read the buyers protection rules and if I was in conflict with them I would of ended the auction there and then and started again.
I think the buyer either thought hey this is a bargain and bid without reading or the buyer thought the same as me and just decided to give it a try - however if that was the case they wouldn't of put a dispute in - just as I didn't to the seller who sold it to me. (Also as used)

I'm afraid mumofone is correct. You used the incorrect condition specifics. This automatically allows ebay to find in favour of the buyer.

The refund will be made immaterial of your paypal account being closed, so do not make another payment.0 -
I have to say im curious as to how you closed your pp account because as far as i am aware you cant if you have a dispute or if you have had recent sales [incase of charge backs,inrs ect]0
