ebay not sticking by own policies

    You've already said you were not going to use them again, so all you can do is resolve this as best you can to stop debt collectors harrassing you for years.

    Many of us here have businesses as well as private accounts so accept that buyers have all sorts of rights. For instance on a business account a buyer can return an item for any reason whatsoever, even a simple change of mind. The trick with private accounts is to accept that buyers do sometimes change their minds, and deal with it as best you can without losing too much on the transaction. For example, I have a returns policy on my private acocutn that allows returns, and as such I can dictate some terms- it has meant virtually no SNAD claims in years, and perhaps only one return, paid for by them, in the last few years.

    Yes I think we are saying that, you sign up to a big page of rules and terms and conditions, albeit, maybe none of us can be bothered to sit and read them all the way through but you break them and you get warned or suspended, and the paypal protection cases and so on , you never think you will need it, have a read through them , and all the same rules apply to everyone we have all been on the receiving end of a case or had to open at least one , maybe ebay is not the place for you, that is your choice to make.

    Lots of buyers panic and just click buy in the last few seconds and haven't even read the auction. eBay will side on the buyers most of the time.

    This is exactly what has happened here.. But that goes against there own policies so are they not in breach??

    This is one of the issues. I have read through the ebay rules especially when it comes down to snad. And I am completely in the right. Of they are the rules make you sign up to surely they have to stick by them to?

    I understand that... Bit they are not the rules on eBay so they should be bound by there own rules as much as we are?

    It could be a faulty antenna or sim reader (both easyish fixes), or it could be that the phone has been reported lost or stolen and has had its IMEI barred. In this instance, the phone is basically worthless apart from use as spares and shouldn't have been sold on ebay as barred phones are prohibited.

    I had a check mend for that. Your right it could be an antenna fault or it could be something much easier... But that is the condition it was sold in. So why can the buyer return due to this? It doesn't make sense and I think puts in A eBay in a spot where they need to stick by there own policies.

    Ebay are a huge worldwide corporate company, you will find they can and do fling off troublemakers be they buyers or sellers, they are partial to rule changes and they normally side with the honest buyer in SNAD cases unless you show them the text from your advert and it proves you described it correctly, if you had said "there is no signal it is dead and for spares or repair only" and it was categorised as such, if you just put used moby has small fault, you are the one who breached the ebay rule , of not the correct description, and the buyer has posted it back out to you and the refund will come out automatically even if you ignore the case .No way to back out of it am afraid.

    Partial to rule changes? Sorry but I don't buy that. They have an obligation to buyers and sellers which is why the rules are in place they cannot change them to suit themselves when they want.

    I correctly put that "the phone gets no service when sim card goes in. I don't know reason and it could be an antenna fault" ... That was in bold and even when I spoke to eBay customer services they saw that and were as confused as me on why it had been ruled in buyers favour. Since then about 8 different people have been involved sending me templated emails and by the looks of it don't bother to read the case

    Ebay update their policies from time to time, to make it safer for us all apparently. If you have had 8 responses from ebay reps they will all be giving very slightly different angles that is why I said earlier, to use the phone line to speak to someone , but by now it is too late for that, the case was decided in buyers favour and they have posted it back to you, it is processing through the post. Although to be honest that is a lot of emails you have sent and you can't weedle of it it you must repay your buyer and then bin the phone as it is as shaun says, highly likely to have been blocked for whatever reason and quite rightly so its prohibited to be sold on ebay and you could face a suspension.

    If it was so easy to repair why didn't you fix it up and sell it as working then?
