ebay not sticking by own policies

    OK I'll repeat that I have a checkmend for the banning proof. And you ask why didn't I attempt to fix??.. Why would I? If I wanted to fix I would've got it fixed then sold it on eBay as a fixed model instead I decided not to bother and sell on and let someone else do the fixing.

    The information I knew about it was described accurately and if they want to purchase with that information there that is up to them but I knew I wouldn't get a "working" model price and that was fine.

    Regardless of that the argument is whether eBay can change there policy to suit themselves and I don't believe they can without breaching UK laws.

    Well then, your only recourse is to take paypal to court and prove they are in breach of the UK legal requirements.

    We are all assuming you are a private seller BTW, although I note you mention having bought this and did a checkmend, which does imply you are a business - so be careful as if you are a business, even an unregistered one buyer has a right to a return under UK law regardless of paypal policies

    No I am a private seller. I don't think it's papal I'll have issue with as my papal account balance was 0 when I closed account. Its eBay that will put me in negative

    Ebay don't hold your funds, paypal do, believe me it is paypal that will chase you, all ebay can do is suspend your account (and anyone elses they think is connected to you).

    If it is your own phone why did you need to checkmend it? The only reason I can think of to checkmend your own personal phone is for nefarious reasons.

    I purchased the phone off someone else who told me they couldn't get a signal. I decided to buy and see if I could by resetting network settings etc... That didn't work and I didn't want to go down the whole route of taking it to a shop and getting it properly looked at but there are people that are happy to do that hence the selling on/the description and the checkmend.

    I thought any purchase you made at a distance you got a cooling off period and could change your mind..

    I thought all ebay purchases were covered by this (I didn't think it mattered if you were a private seller or a business)...

    Has the item got back to you buy recorded delivery?

    No on private buyers it does say reasons you cannot refund are:
    Change your mind
    Defect correctly described in auction.

    And a few more.

    If these weren't here I would happy make the refund and move on.

    If you buy a car and they say yeah I can't get the engine started... As if you could take it back saying yeah the engine doesn't start.

    Apparently there is tracking on the item and its on its way back.

    The 7 day "cooling off" period is covered under the Distance selling regulations and only applies to sales from businesses. (when the sale is made by a consumer).
    There are other stipulations and exemptions, one of which is that the cooling off period doesn't apply when buying from auctions.

    Don't be tempted to refuse to accept the phone when it arrives.
    If you do this, your buyer will still get their refund and the phone will get returned to them also (if they put a return address on the package)

    You should check the phone when it arrives though - if the buyer is playing games then it might not even be in there/could be damaged further...

    If you can't take helpful posts with the trolls, then maybe advertising your problem for anyone to comment on isn't what you should do.

    Onetwothree is an acquired taste, don't take it personally.
