ANPR parking ticket for trespassing nightmare

I been issued with a parking ticket for apparently trespassing in a private car park (behind my house) without a valid permit. There were no signs displayed in the private car park the night before when I parked it. The next morning I confronted the Guy whilst he was writing the parking ticket to put on my car an I told him that there were no signs there the night before, he said that the sign was there and it had fallen to the bottom of the lamp post an it was still visible, which is a complete lie as I did not see it there before . the sign had already been fixed to the middle of the lamppost just before he issued the ticket.

In the past there were two signs in the car park for trespassing, and i did not park my car there. but the signs had been removed by someone about a month ago.

The parking ticket was issued at 13:45 , i had confronted him at 13:55, and tried to reason with him, telling him there were no signs displayed. he said it was too late that my details were already on the system.

The registered keeper of my vehicle is hertz, and im not sure if I will be charged by hertz if they provide my details to ANPR.

the car park was completely empty, my car was the only one parked there so i can see how this has caused liquid damages to the landlord which is 100 pounds

No sure what to do, feel stressed.

PS: The guy who wrote the ticket did say he will mention that the sign was at the bottom of the lamp post on my behalf if i appeal against it.

    Is this ANPR PC or ANPR Ltd?

    You need to respond to the fake PCN and get a grip, it's a scam. You must send an urgent challenge because that will hook the scammers to have to write to you - removes Hertz from the Equation - and will allow you to get to the second stage POPLA appeal. Read the forum please, red any threads to learn about POPLA!

    If this was ANPR Ltd (a joke of a PPC on this forum) then I would like to see their reply to your challenge which should be sent like this (not saying who was driving NOR tipping them off that it was a Hertz car). You can use a less rude version if you like but NOT worded 'I was driving' or anything like that:



    'Dear ANPR Ltd or National Clamps or whatever Trev the Clamp/Bob the Builder thinks up next before he retires,

    I have received a 'ticket' ref xxxxxxxx which was on my vehicle.

    I need to you explain to me, in readiness for yet another POPLA loss funded by yourselves, whether this is issued under the Tort of trespass or as a breach of contract and how the amount is arrived at as it is extortionate. A pre-estimate of loss, never. Clearly it's a penalty in the Dunlop sense, and who are you kidding? It seems you may be expecting me to believe that you are actually in breach of your contract with the landowner to the tune of £100 so of course I require proof of this preposterous contention, which I sincerely believe that your Trev the Clamp has made up. He would have been bankrupt within months if this is how 'ANPR Ltd' run their business, at a permanent loss repeatedly paying £100 to clients every time a car parks. My Goodness, your clients must be rich and laughing behind your backs!

    I can tell you that there were no signs in that place at all when the car was parked, which supports my case whilst diminishing yours...!

    And if 'N Martin' replies and offers to send an independent appeal to POPLA 'on my behalf' then I will report you to the DVLA and BPA Ltd and to the Office of Fair Trading for sharp practice. Your 'big boss' Trev the Clamp knows that if you reject this challenge, a POPLA code has to be sent to me along with a form or a weblink for POPLA, so that I can appeal there myself; obviously an appellant DOES NOT use a POPLA code to write again to N Martin, who appears to need retraining and is in danger of letting people 'time out' as far as timebound POPLA codes are concerned. Why is this, I wonder?

    As an alternative, you could always cancel the fake PCN seeing as it's obvious where this one is going - a POPLA win for me, with online forum help. Good luck with rebutting that.

    Belt and braces. You must make sure that you inform that PPC that you were the driver AND the vehicle hirer that you have informed the PPC, are taking full responsibility for dealing with this and under no circumstances are they to make any payment to the PPC.

    Tell the hirer that you are complying with the POFA 2012 section 4 and require them to comply as well.

    It's a fine line isn't it...whether to 'out' yourself as the driver or not is a hard call (or whether to just imply it by challenging the fake PCN). Because as soon as a PPC knows who was driving they don't even have to bother with POPLA or POFA so makes their life easier in some ways.

    Certainly the OP needs to write so that Trev writes to them.

    Don't admit you were the driver just challenge like you are the keeper, that is allowed under pofa 2012, I would be tempted with sending Coupons letter above just for the entertainment value from Trev :) but consider this as well. You are considered the keeper of the vehicle only, not necessarily the registered keeper

    Dear Scammers,

    In regards to the invoice received with ref number xxxxxx dated xxxxxx, the keeper denies all liability to your company, if you reject this challenge the keeper requires within 35 days a popla verification code for them to appeal independently, per Version 3 of the BPA Code of Practice.

    The keeper has nothing further to add, and will not respond to any correspondence from your company unless it contains the popla code. If you wish to find out why the keeper rejects all liability, pay the £27 plus vat to popla to find out

    The challenge will be deemed accepted if there is no popla code on any rejection that you supply within the time-frame stipulated above.

    So it's a pattern of IMHO allegedly, fraudulent replies and abuse of POPLA codes by misleading appellants so the codes time out.
