Charging £10 for statements

    Yes you are wrong, totally.

    The £10 is the maximum statutory fee for making a Subject Access Request as per the DPA. This entitles you to request data that is held on you by any particular "data collector".

    If you ask the bank specifically for statements they are entitled to charge for the service. Some charge £5 per statement page.

  • I didnt send any payment along with my requests to CC Companies, does this mean they will wait 40 days and then ask me for £10?

    Or should I write to them again enclosing payment?

    The £10 is a statutory maximum, it isn't compulsory for the firms to charge that, although most do.

    Given the bank's propensity for stalling it's pretty much certain that they will let you wait as long as possible before telling you that you didn't enclose payment.

    Personally I'd write a follow up letter referring to your original letter and enclosing a cheque.

    This is why all the SAR templates from reclaim sites include making payment. It prevents the bank/ CC Co from taking liberties. If they are prepared to do it for free then they will return your cheque.

    Theoretically you can use the date of the first one now that you are making the payment. The request is dated from the first letter ordinarily, not the date of payment. It's a bit of a grey area this one.

    Write again and enclose the money.
  • I deliberately didn't enclose a £10 cheque with any of the 3 letters I originally sent...

    - Abbey
    - Monument
    - MBNA

    All sent me lists of charges without any fuss! Abbey took their time like, but Monument and MBNA sent within 7 days... didn't have to pay a penny:confused:
  • Well I suppose i did "deliberately" didnt send the payment with the request for the charges, suppose i was hoping that they would send them anyway, or at least contact me quick to get the money from me and then delay giving me the info.

    However, i have just written follow up letters to all of them and enclosed payment, will post them today. I didnt want them to get me to wait 40 days and then tell me they needed £10 from me, and then id have to wait another 40 days!

    The credit card companies are:

    Nat west credit card
    RBS credit card
    Tesco personal finance credit card
    Mint credit card
    Monument credit card
    Citi card credit card
    Littlewoods personal finance credit card

    ALL OF THE ABOVE ACCOUNTS ARE CLOSED (except Tesco), as over the past 18 months I have made myself skint so i could become debt free, so am hoping that i can get some money back and have a holiday!!!

    theroically you should do that way your playing by there rules.. if you dont send one in. They could say you was in breach of your contract and there for not pay out.seems strange that they wouldnt request the admin fee it cost them to print off and send, if nothing else for the postage of them! We sent cheques to all of the banks and within 7 days got the one from natwest, still waiting on the Lloyds tsb one tho..
