    Ok ... i now have a reply from highview ... i now have a Legal Action Letter , and a bill for £120 plus the threat of not being able to obtain credit in the future .. So what now ! i have had no acknolegement of my email to appeal .

    Personally, I would write to them, via mail with a posting receipt retained, enclosing your email, repeating your demand for the POPLA code and informing them that you are within your 28 day window from receiving the NTK (are you???) and that, having asked for your POPLA code, they are not entitled to raise the amount demanded and you will be reporting this to POPLA and BPA.

    Now that all assumes that your first letter (NTK) from them was on or around the 20th June and not a couple of months ago.

    Please clarify dates etc so we can tailor advice exactly.

    e mail was sent on thurs 20th ... the first letter they say they sent i never recieved so was only able to reply to the second demand ... the date of the original "ticket " was 11/05/13

    the date of the first notice sent( although we didnt recieve it ) was 23/5/13

    So the Notice that you never got, was deemed to have been served on you by the following Tuesday 28th May as there was a Bank Holiday on the Monday.

    And your email challenge was sent in time anyway, within 28 days of 'assumed receipt' of the first letter! I would respond along the lines already suggested by Guy's Dad, and keep the original letters of course (and envelopes if the postage date is different than the date on the Notice inside).

    Tell them you never got the first Notice but thank them for jumping the gun and writing again because as a result of that your challenge dated 20th June was still in time. Finish by saying 'POPLA code please, or cancel'.

    i have just sent another letter and email too ... i have requested again the POPLA code and said that i would be contacting POPLA and BPA if a code is not isued or the ticket cancelled . i have also told them that i will be letting them know of my administration costs in due course ... cant believe they want to charge me £40 admin !!
    shall i contact POPLA now and say what has happened and the BPA or leave if for a few days ?

    Highview Parking are notorious for sending tickets to double dippers at Yate.
    As this is far from the first time this has happened, and Highview must know this, having been told in (probably) multiple appeals, then a strong complaint to the DVLA as Highview are obtaining vehicle details without proper cause - repeatedly and blatently in full knowledge that their ANPR system does not work, and in demanding money when they KNOW they have no case. Then, keep badgering DVLA, who will fob you off.

    i have telephoned POPLA and they gave me the BPA number .. after calling them i have resent my appeal yet again and included their advise.. " copies of all correspondance highview have sent me need to be re issued as not all copies were recieved, and they have to respond to my appeal with either a cancellation of the notice or a POPLA code ... " The BPA have said they will be breeching the Code of practice if they dont.
    the BPA advised me to contact them again and they will investigate them if they dont follow the procedure .
    we shall see what happens now !

    Are you sure you called the right number? :rotfl:

    BPA must have been having a bad day - 'putting the customer first' by the look of it (as they say in their blurb).

    I've also had one from Highview, overstaying in a supermarket car park.

    As I understand it the advice has changed from "ignore" now, or has it?

    There is currently a thread on PistonHeads where someone is being taken to court by an unnamed PPC, possibly as a result of him identifying himself over the internet and the PPC then seeing it and making the link.

    At present I haven't identified myself as the driver so I could still play the ignore card. An email/letter to the supermarket also could probably sort the situation I imagine, but does the ignore card still work?
