    so worst case scenario POPLA appeal rejected, PPC doesn't back down, taken to small claims court and recieve CCJ if I then don't pay it? but this is very unlikely and my other option is to hope the PPC backs down... I feel a bit nervous about it as I've worked quite hard over the past 6 years to improve my credit :\

    The £32 can be ofset against tax, it costs them nothing, it promotes POPLA and the legislation will be amended to make the decisions lawful as it will be seen as a rip roaring success and money spinner for the government .
    People should have just continued ignoring and let them take you to court if they think the unlawful penalty is enforceable.

    the £32 can be offset against income. tax is on the profits a firm makes.

    You dont offset costs against tax itself.

    This will cost them £32 of profit, and maybe save £6 in tax. Net impact is a reduction in profit of £26 or thereabouts.

    It does cost them money.

    1. PPC backs down straight away - THE END
    2. PPC doesn't back down so you go to POPLA and win - THE END
    3. You go to POPLA and lose - you ignore - MORE THAN LIKELY THE END

    5. PPC takes you to court, you lose - YOU PAY, THE END and no CCJ

    You will only get a CCJ if you lose and don't pay what the court says. Are you really going to do that ? ONLY the CCJ can affect your credit record.

    PS - no need for nerves, I've had two PCNs from G24 and one from Parking Eye. Guess how many I've paid, how many times I've been to court and how many CCJs I have ?

    thanks I know its more than likely it will be fine but just so I have all information. If the worse case scenario of court, they win what would the total fine be ? the max £150+ interest?

    It won't see the light of a court as you had a permit which I assume you can prove so stop worrying.

    IF, and it's a very BIG if, they took you to court all they can claim are their loses due to you "breaking" the contract - nil - and costs ( about £85 in court costs ) and a little bit of interest.

    You have the same chance of being taken to court as I have of waking up tomorrow and finding a naked Kelly Brook in my bed :D

    Is there any mention anywhere on their signs that the pass must be displayed on the dashboard or windscreen? If not, and it was face up, resting on the driver's seat could be argued as displayed.

    Why not take a photo of your pass on your driver's seat showing clearly that the details can be read?

    Not suggesting that this alone would be a POPLA winner, but if the preceding 2 paragraphs stack out, then make it one of your major appeal points - with photo - when the time comes.

    i'm sorry i've got another question.

    how do I know whether the parking company has backed down when i've submitted the POPLA appeal? Do I get a letter saying it's been revoked? Will I hear nothing?

    I got a CCJ 7 years ago and I just recieved it in the post, there were no other warnings until I had a court letter.

    It didn't help I just had our transport person phone me and try to scare me into paying it, really annoyed at my employer now. A whole days salary taken for parking at my place of work just so they can make money out of us, disgusting.
