Sold item buyer said it was broken returned and it works??

    I think thats what i will do. ONly thing that worries me is if he refuses the parcel in which case it will come back to me. What will i do in this case?

    Gosh, this would have been so much better on the ebay forum.

    Firstly, assuming this was a paypal payment for named goods (if you paid fees on it then it was) buyer merely has to open a SNAD claim and will almost certainly win.

    All this nonsesne about photograhing things and taking details of dates is a red herring, this could go badly for the OP and OP seriously needs to cut their losses now and get out of this with as little loss as possible.

    If buyer has sent it back tracked to the OP then the OP would be foolish to return it again and pay even more outward postage.

    If buyer decides to bypass paypal and go to court that will again cause the OP issues- even if they win at that point.

    If however paypal payment was received without any fees then it was a gift payment which means buyer has no rights under paypal so would have to go to court.

    I'm stubborn, so I wouldn't budge on the refund.

    Make sure you block him from your eBay so he can't purchase anything else from you through eBay.

    He has now made a private sale, nothing to do with ebay so they cannot be involved surely?

    As to the tone of those emails I think I would be digging my heels in too. However I just see that the sum involved is £500 and so for that amount the buyer is not going to go away. However I would imagine it is just a case that he changed his mind once he received it and is now trying to get out of it, but as it is a private sale that is not your problem. So for that amount I personally, if I wanted him to go away, would offer a refund minus all expenses incurred. Or if I was going to dig my heels in and I would consider that right is on your side - tell him to arrange collection of his working item.

    From the wording of the guys reply it sounds like he's been reading up about sales of goods act - which isn't relevant for private sales.

    I'd just pay to return it and ignore it.

    I'd certainly be happy to defend it in court and see his face when a judge awards you travel costs. Take the item to court and hand it over there and ten, £11 saved :-


    You offered him a refund in good faith that it was faulty as he claimed. And it's not.

    As he wants to bully you.
    Dont refund him dont reply to his emails, just let him get more and more angry.

    I would treat him as entertainment.

    If which he probably wont, takes you too court, dont appear and that will make him even more angry.

    Just laugh at him and spend his money on some beer then put the thing on ebay under a different user ID and make some more money out of it.

    Note, if he wasnt bullying you i would have offered a partial refund.
