Sold item buyer said it was broken returned and it works??

    I emailed him telling him the unit is fully working and i got this reply
    "The unit is faulty, not as decribed and accordingly it has been returned to you, and I wish a full refund to be provided within the next 24 hours as agreed. Should you unwisely decide not to provide this in the next 24 hours. I will take other means in recovering my money. I really do not care what a forum says."

    i then emailed him this "The unit isnt faulty its fully working. Ive had advice from a forum and DSR never came into it as i thought. Please arrange it to be collected. Im well within my rights to charge storage costs for this amongst other things"

    which he replied

    "Do not try and be clever. Whoever gave you legal advice does not know the law and neither would it appear do you. You currently have the goods and have agreed in writing to provide a full refund upon return of said goods, which you are now stating is not forthcoming.
    Let me state again very clearly: refund by 8:00am tomorrow or I will take further action to recover the money. If, as you state, the goods are not faulty (which I dispute) re-advertise and sell them on ebay. I am not prepared to negotiate further."

    Not true.. it depends whether the seller sent the payment on paypal as "Goods" or "Gift".

    Doesn't seem to tell me this on my paypal payment i received
  • Its better to refund the amount instead of all the head ache and again sell the same good in ebay if it work properly.

    To be honest i cant deal with all the hassle if there will be any? If im in the right though i really dont like the way he has spoke to me in previous emails so would prefer for him to have the unit

    Just feel bullied by him and its like i am being forced into refunding him for something which works perfectly at cost to me with all the packaging and postage

    Just send the whole thing back to him and ignore the muppet.

    His veiled threats would make me dig my heels in more, and I'd wait and see what he did at 8am tomorrow. What a goon.

    Thats one of the reasons i want to stand my ground. Just sacred im going to end up in court or something like that and end up with court fees

    If you've got evidence the product works, what are you worried about?

    The buyer sounds like a grade a mong. Send it back (take the hit), ignore him and if he's dumb enough to take you to court, turn up with your video evidence and laugh as his case is thrown out.

    Just make sure you film the date from a newspaper and the serial numbers of the unit.

    The court won't side with him if you can prove the item works. Especially not with regards to a private sale where he has no rights anyway.
    I'd refund him minus the cost of any losses you've incurred.
