Wrong, you've read old threads when you say 'can I ignore this?'. Read current ones on page 1 or 2 of the forum (about any PPC fake PCN). You have appealed and so it's YOUR fake PCN to then appeal to POPLA. Please just read up about it on new threads - and not old threads that say ignore it. I posted that link with a warning that it was old advice, didn't my post above say 'watch out as you shouldn't ignore it'??!

That's a Notice to Keeper. How come you have this, and not the registered keeper, if you borrowed the vehicle? Did the RK receive it and pass it to you?

I was borrowing the car, they passed it on to me and asked me to deal with it.

Thanks for the help Coupon - Mad, apologies for not reading your post correctly, trying do this whilst at work too. However it might be a bit more helpful to day 'here is a link you should follow' instead of posting a link I shouldn't and then being passive aggressive afterwards ;). I was under the impression this forum was to help :D

Anyway by the by, thats the letter you asked for, is that a fake private scam?

I showed you the link to show you all about the scammers you were dealing with, so that you would indeed understand this is a private fake PCN! :)

Guess I was passive-aggressive as I was busy at work on the one hand, whilst also posting here with the other - sorry! :o

So for you to handle this, you need to send a letter from the Registered Keeper naming you as the driver (name and address). DO NOT appeal it yourself at this stage, do not write in response to it yourself. It should be the keeper who names you, then you wait for your own 'Notice to Driver' as long as you never had a windscreen PCN at all?

Here's the front of your Notice to Keeper: LINKY

Can you please post a pic of the small print on the back too?

Was there never a windscreen PCN; was this the first that was heard of it?

    Sorry bad day at work!

Ive left the letter at work but Ill post the small print tomorrow, bad news is that I already sent a letter of appeal before the owner said I was the named driver. I never had a window PCN this came through the post so the first I heard of it. I panicked and sent the appeal, does this make the process harder?

thanks, and sorry for sounding mardy

Gives you one less appeal point! One good reason for waiting for the Notice to Keeper or Notice to Driver before appealing is because most of these are not worded to comply with the Protection of Freedoms Act 2012. You just lost the chance to tear into that Notice, in your POPLA appeal, that's all.

As long as you are in England/Wales then you should soon get a rejection letter (of course, not an acceptance of appeal, LOL!) which will/should offer you POPLA. So it's a waiting game for you now.

In the meantime, whilst waiting for your rejection(!), if you are local then get pics of the signs showing the non-compliance of wording, lack of signs, etc. Bound to be a lot of non-compliance with the BPA Code of Practice if you just read it, including the requirements signage.

    Damn it

Wish I hadnt been so hasty! Whats the likely hood of this getting approved by POPLA?

I know for certain there are no entrance signs, and the sign I posted certainly doesnt comply to this..

You should display the BPA and AOS logos on all sites.
This will help the public to see that you are a legitimate
operator, and show that the site is run properly.

There also isnt any mention of automatic registration capture which I guess they also need to display.

Wow I feel of my depth! Ill post the small print tomorrow, in the meantime is there a standard response I can get ready for POPLA?

Good start and you do not appear to be out of your depth at all!

We have 100% success rate with our appeals to POPLA since March, when we saw some of the first decisions and worked out what their law student part-time adjudicators like!

Ok got the rejection letter back.

Do I just need to write to POPLA? If I do that does that then put the demands on hold?
