    Let me try to make this simple.

    Regardless of the "offence" that a PPC claims you have made - and in most cases you will have broken their so-called "contract" - your appeal is NOT based upon that.

    It is based upon the right conferred by contract for the PPC to charge you anything, the amount of their charges being a genuine assessment of their "losses" and not disproportionate or any form of penalty and the fact that they must abide by the POFA 2012, the BPA Code of practice (their own association), and POPLA requirements.

    This has been the basis for all successful POPLA appeals, with only 3 cases of mitigation ever being referred back to the PPC.

    So, do some reading on the POPLA APPEALS sticky, plus parkingcowboy web site, ready for the inevitable rejection that you get from the PPC. But the clock is ticking. Use stroma's excellent initial appeal letter - it also tips them off that you are being helped by a forum - and then come back when you have the POPLA code.

    So, the reply from PE has arrived. "the appeal has been unsuccessful due to the fact the car park is pay and display" they have provided me with the POPLA ref no. what do I do now? HELP!

    Hi I had a letter from parking eye I have ignored the letters so far yesterday got a 4th one saying court proceedings Will be taken whereas letter before said MAY be taken should I be worrying as I am starting to thanks x

    OP - no need to panic. Just take a little time to do a bit of reading and research and prepare yourself mentally for starting to develop your POPLA appeal.

    We will help you with your appeal, but you do need to do some of the leg-work yourself as everyone advising on here only has limited time available through trying to help everyone.

    Main thing - don't go it alone to POPLA and don't base your appeal to them by 'telling them your story' (no matter how good it is and how wronged you feel).

    Come back once you've started writing your appeal.

    Jeez, you're some optimist :). Do you worry when you go out your front door that today may just be the day the sky falls down?

    Pull yourself together - if you read the links I've taken the trouble to provide you, you'll soon start to realise that since March all POPLA appeals put forward with the help of MSE or Pepipoo have been WON - a 100% record. So if you follow advice from us, why do you think your appeal might be any less successful?

    But, in case you can't sleep tonight, if you do lose at POPLA then their decision is not binding on you (only on the PPC) and you can continue to ignore. It's then up to the PPC what they might decide to do.
