Parking Eye

I know there are lots of posts on this but I am getting a bit confused.
I received a parking eye charge after parking in a carpark under the advise of an estate agent for a house viewing, they advised me not to pay for parking as it was only going to be a short period.
I have since received a charge for £60, raising to £100 if I do not pay.
I am unsure if I should just ignore this and face further threatening letters or if I need to do something else, I understand I do not need to pay as this "fine" can not be enforced by law?
Please help!

    Can you tell us if this is in England or Wales ? If so you need to challenge this as ignoring increases the chances of a small claim. And paying them just gives them money to fund this scam. Send this soft appeal to get them to send you a popla code to appeal independently . We can help you do the appeal

    In regards to the invoice received with ref number xxxxxx dated xxxxxx, the keeper denies all liability to your company, if you reject this challenge the keeper requires within 35 days a popla verification code for them to appeal independently, per Version 2 of the BPA Code of Practice.

    The keeper has nothing further to add, and will not respond to any correspondence from your company unless it contains the popla code. If you wish to find out why the keeper rejects all liability, pay the £27 plus vat to popla to find out

    The challenge will be deemed accepted if there is no popla code on any rejection that you supply within the timeframe stipulated above.

    In England, So even if it my fault for parking without a ticket, well being advised not to, I can still appeal?

    Yes of course you can, a parking company cannot fine or penalise you, this is all about that. Think about it in your time there would you have caused them a loss of £100 ? What you owe is the couple of pounds for not paying.

    The appeal to popla won't even be on whether you paid or not, that is mitigation and they don't make decisions on that. We will dismantle their entire business, they will have to prove things like their contract and legal right to ticket. They won't show their contract as it will show things that will unravel their business.

    So just send the soft appeal above it leaves them no room to wriggle so they must either accept or reject the challenge, if they fail to jump through certain hoops they cannot pursue you. Send the above via post with proof of postage from the post office (not recorded) its free

    Your fault? Of course you can appeal and anyway the driver was parked with the express authority of the agent in possession of the keys for the property, so that would have formed a prior contract if the parking space was allocated to the flat.

    Please read a few threads - ANY PPC - about 'POPLA appeal wording' (second stage where you will win if you word it right with our help!). You will see that there is NOTHING about 'what happened' in any appeal we recommmend nor about admitting liability nor even implying who was driving. So do NOT add to Stroma's template and do get help when you are at POPLA stage before rushing off a losing appeal.

    So - apart from the 'prior agreement with estate agent, prior contract' angle, anything else about 'what happened' is irrelevant, strangely enough. We win POPLA appeals by pointing out what the PPC has done wrong so keep all their letters.

    Think parking eye is not doing email challenges anymore, they probably figure they get less challenges if its done through the post. So get a proof of postage from the post office for anything you send to them. It's free

    Have just managed to come back to this. The place I parked was not allocated to the flat, it was just a private carpark a short walk away from the property, does this make a difference to chance of appealing?

    Nothing to do with whether or not you can make an appeal. Just get the soft, basic appeal done as per Stroma's advice, and do it right now.

    All of this stuff is time bound and you need to make sure you work within the deadlines to ensure the greatest chance of success.

    Delay now, or ignore, will bring you even greater problems to deal with further down the line. Best get this knocked on the head ASAP, via POPLA, after your soft appeal is guaranteed to be rejected by PE.

    Come back to confirm you've sent it and we'll advise you of your next steps then.
