PCN from Civil Enforcement Ltd

Hi,

A PCN relating to my vehicle has been received.

Am I obliged to supply details as to who may have been driving? I have not seen any photographic evidence.

They are trying to charge £45 (if paid within 14 days) for an apparent overstay.... even *if* the driver did commit said contravention, I fail to see how the land owner (Co-Op) could have incurred this amount of financial loss within the short time-frame which supposedly constituted the overstay.

Should the PCN be ignored or appealed, and if so, who should it be straight to POLPLA?

    Second one today from this company involving the so called ethical coop. This lot do small claims in your place I would challenge this to circumvent this. If rejected you can appeal to popla the independent appeals. No matter what you write it will be rejected.

    It's up to you if you want to the name the driver, but there are a lot of reasons not to. So just send this to them

    Dear Scammers,

    In regards to the invoice received with ref number xxxxxx dated xxxxxx, the keeper denies all liability to your company, if you reject this challenge the keeper requires within 35 days a popla verification code for them to appeal independently, per Version 2 of the BPA Code of Practice.

    The keeper has nothing further to add, and will not respond to any correspondence from your company unless it contains the popla code. If you wish to find out why the keeper rejects all liability, pay the £27 plus vat to popla to find out

    The challenge will be deemed accepted if there is no popla code on any rejection that you supply within the timeframe stipulated above.

    But your first port of call must be to COMPLAIN to the Co-op Store Manager (not the teen or frump on the CS desk, sorry but it HAS to be the Store Manager, not even a random 'Duty Manager'). Pretending to 'fine' genuine unsuspecting customers isn't in keeping with the Co-op ethos and is sharp practice. Show your receipt and the offending fake PCN rubbish to the Store Manager, get really assertive about this and threaten to tell all friends & family never to shop there again. Try that first.

    One step at a time.

    First the soft appeal as per Stroma.

    Then wait their reply.

    Keep a note of the dates of correspondence sent and received as they have to follow strict timetables.

    Then come back for POPLA help.

    I've already emailed the Chief Exec along those lines. For a company that makes a big noise about ethical trading, it strikes me as surpising (put mildly) that they are willing to employ the services of a firm that some may regard as rather unscrupulous.

    Perhaps irrelevant, but if I were leading an establishment whereby a 'fair trade' ethos is championed as the unique selling point, I'd be slightly concerned that the risk to reputation and credibility is far more apparent than any financial gain. Just a thought.

    Anyway, in the meantime, I'll stick an appeal in to the delighhtful folk at CE Ltd.

    Sorry, meant to ask....The appeal process will presumably take me over the 14 days, therefore I'll be required to pay the full amount should I be unsuccesful? Is that correct?

    You won't be paying anything, but yes they will up the amount on their letters. So what?!
