Tesco - Highview Parking June 2013

Had a quick look, but slightly confused over current legislation.

Received a 'charge notice' from Highview Parking following a lengthy stay in Tescos. I am at fault as I was there for a lengthy period of time due to doing other things in addition to shopping.

I'm all for just ignoring letters, I appreciate things only get difficult if I get summoned to court, lose, then don't pay up.

However, I'm confused over a Popla? And that I must do one ?

To be honest I'd rather just pay the £40 than bother with writing any letters, and getting the sent recorded delivery.

    Popla can only be accessed if you first challenge the parking company and they reject that in England or Wales only. You are a customer of tesco go there and speak to the store manager and demand they cancel this.

    As for paying, why waste money when you can appeal this and win for nothing, not even the cost of a stamp as you can do it via email.

    Thanks, but I'm still confused.

    I need to challenge the charge with Highview, then have them reject it?
    I'd rather not write to Highview and acknowledge the charge, only for them to ignore my letter.

    Is there a simple step-by-step guide on this, or other forums?

    So, ignoring is no longer a viable option?

    No matter what you write to them they will reject your challenge, the important one is popla, send this to them to get the popla verification code from them. And there is no step by step way to deal with this as there are to many variables involved

    Dear Scammers,

    In regards to the invoice received with ref number xxxxxx dated xxxxxx, the keeper denies all liability to your company, if you reject this challenge the keeper requires within 35 days a popla verification code for them to appeal independently, per Version 2 of the BPA Code of Practice.

    The keeper has nothing further to add, and will not respond to any correspondence from your company unless it contains the popla code. If you wish to find out why the keeper rejects all liability, pay the £27 plus vat to popla to find out

    The challenge will be deemed accepted if there is no popla code on any rejection that you supply within the timeframe stipulated above.

    Ok, seems straight forward. I type that up, send it to them recorded then wait?

    I do nothing further until they reply with a Popla code?
    I personally do not approach Popla until after Highview send a code?

    Can you see where the confusion is? The majority of posts on this forum say to ignore all letters and do not communicate with them. But now it seems sending in an appeal is required ? Then what?

    You are reading old advice, since October 2012 the Protection of Freedom Act has been enacted in England and Wales. So the tactics of certain companies have changed, so we must adapt to that situation.

    Please don't send letters recorded, just get a free proof of postage by the post office. And you cannot go to popla with the code from the parking companies

    Ok, I'm definitely being thick here.

    I write and appeal to Highview, which presumably they'll reject.
    I include wording saying all correspondence from them needs a Popla code.

    Then what happens?

    After you get a code for popla, come back here for help to formulate a defence for it, please don't do this alone as you will need specific wording to get this fake ticket cancelled.

    If you ignore it all, there is a minute chance that they could do a small claim, but IMO they will not have the authority to do that within their contract with Tesco, I have yet to see one claim from them at all, let alone from a tesco
