Parking Eye

My dad has had letters from Parking Eye In the past, and as I had read that the best course of action was to ignore them, he has done so. Of course, now that rules have changed and the whole POPLA thing has started, I'm now worried about the latest letters that arrived yesterday. My dad has had 2 'Letters Before Action' - one citing an overstay in an Aldi carpark last Nov, and an overstay in the same carpark in January. I have now drummed it into him to time himself and to get the hell out before the 1 hr 30 mins is up, so he's not had anymore 'parking fines'. But as he's now had 2 of these letters, arriving at the same time, saying that unless he pays £70 for each in 14 days, further action may be taken, and court proceedings may be issued. Unfortunately, I'm the one who is going to have to try and sort this out, and I feel bad as I think he would have paid them when they were at their lowest amount had I not told him to ignore them. I don't know where to start. Is it too late to start an appeal now that we're on the 'LBA' letter, and if it is/isn't, what the heck do I do. Any help would be appreciated.

It's to late to go and start the appeal as parking eye will ignore it. There is more than fair chance that they will chance their arm at a claim now. But that doesn't mean it equals a win, the guys over on https://www.pepipoo.com can help you with that.
But before that happens, complain to the retailer on your dad's behalf if he can't do it himself, show receipts and the threats from this company because he overstayed shopping at their shop. Do talk to the store manager only and their head office. Does he have receipts or bank statements proving a spend?
And finally is your dad considered disabled under the Equality Act 2010? Not does he have , that doesn't just mean a blue badge, stuff that effects his mobility in any way, or anything else under the actWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. No, no disability, just general doddering, and he is a pensioner. I've just given him the letters and told him to do as you suggested in regards to talking to the store manager. He says they won't do anything, but this company, who they have employed, are hounding their customer. He's in there every week and is a good and loyal customer to them. I think that's what's annoyed me so much. If he has no joy, I've told him to ring their head office, and I'll pop on over pepipoo to see what they think. Thanks for the advice. Part of me just wants to pay it off myself and get it sorted.
Oh and just editing to say, we think that one of the times, he'd broken down in the carpark and had the AA out!0 -
Don't ring their head office write emails or letters with a proof of posting. And the AA slant is another angle, if they been out and attended a breakdown get proof of that like a receipt or letter, that is a strong mitigation as a breakdown cannot normally be foreseen. This is a very strong appeal point.
And are you sure nothing under the equality act, something like diabetes or arthritis is coveredWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.

He has nothing like that. High blood pressure is all there is really. I think one of them was a breakdown, but to be honest, he's a bit ditzy and has got a few parking notices, so can't totally sure that it happened in November. Suppose it's time to ring the AA and ask them if they have a record of when they came out to him.
And check, will email the head office rather than ring them.0 -
Yes check on the AA to see if it covered one of these tickets, if you do go to pepipoo with this if a claim comes, make sure you mention the breakdown and that it was attendedWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. Rachel, why don't you get a proper job instead of threatening old and vulnerable people with your stupid threats of court? I bet when you started your legal training you did it with all the best intentions, hoping to contribute to society. Look where you have landed yourself. Working for a company that some people would call a protection racket. What part of "A whop bop-a-lu a whop bam boo" don't you understand?0

It is awful, making people worried and scared about being taken to court. I really feel like just paying it off for him to be done with it.
Unfortunately it turns out he hadn't broken down on one of the dates, it would have made it easier to fight it rather than just overstaying his welcome. He went into the store today and they basically said it was nothing to do with them - the parking company isn't anything to do with them. I don't see how that works, as surely, they can't just set up shop in Aldi carpark without their permission. I can't seem to find an email address apart from a media press office one to contact Adli direct.0
