so it sets no precedent why are there now loads of people in here quoting the show saying can they get out of their contract

I didn't catch Watchdog so didn't see the story. Do you know if she received the usually text you get advising you of charges when you land? If she didn't receive the text then I can understand that she may not have know the charges (assuming she has never taken a mobile phone to any other country before) but if she received the text and still won... well I'm shocked!

I think the issue is not so much whether she knew about the charges for data but whether the phone would passively use data in the background.
