anyone watch it tonight-apprently someone took t mobile to court over data charges because she apprently wasnt old about them over the phone when she signed up

somehow she won i think she just should have turned off data roaming

    It's not about whether or not mobile data would cost, but whether it would cost more in Australia than in the UK. Many services, for example eating out and accommodation, are roughly the same cost in Australia, so a reasonable person would assume that mobile data would be roughly the same price in both countries.

    I refuse to believe that someone as educated as a lawyer is not aware that phone calls are more expensive to make across international borders than they are domestically

    Therefore, reasonably, it can be assumed a person would know that data roaming, as with a call, would cost more.

    Roaming calls can be cheap in comparison to data though lol, frankly roaming should be calling and texting, data roaming switched on separately...a €40 cap is no good if you dont have the €40...something go think about esp after a holiday. Rather have to call to activate my data roaming then I know the iphone etc...is doing nothing.
    SO... now England its the Scots turn to say dont leave the UK, stay in Europe with us in the UK, dont let the tories fool you like they did us with empty lies... You will be leaving the UK aswell as Europe ;)

    I agree that roaming charges are ridiculous. But then so are text message charges! 10p for 160 characters

    In text file terms that's about 1/6th to 1/5th of a kb. About £500,000 for GB of internet data by my reckoning.

    A contract is made when the terms are laid out by one party and the other party accepts. As long as there is an exchange of something of value, you have a legally binding contract.

    Angela took out a mobile phone contract with T-Mobile over the phone.
    She explains,
    ‘We just discussed the main terms which are the length of the contract, how much my monthly bill would be and how many inclusive minutes I would receive with that tariff.’
    ‘We didn’t discuss any other terms and conditions, they didn’t bring any other terms and conditions to my attention and they didn’t give me the opportunity to review anything at that time.’
    Commercial Lawyer Mark Weston explains,

    ‘At the point in time when all of the terms of the offer are laid out, and at the point in time that those are accepted, those are the terms of the contract, so any data roaming charges that were introduced after the contract was made, are not part of the contract.’
    many people post on this forum with problems of big bills on stolen/lost phones, unsolicited premium rate charges etc etc.

    I wonder how many of them have been given the wrong advice from Moneysavingexperts?

    Yet I'm told its me who zpeakz through hole in my a*s.... I dont just read government websites, I did law :)


    You find more than a few who stand to grounds behind their username are company employees of the highest calibre who are here to mislead as they know MSE has a massive following since Martin went TV, cheap misleading PR....

    Phone calls are not more costly across international borders. For example, my home phone gives me unlimited calls to fixed lines in most of the EU, North America and Australia. The cost of phone calls is based on the termination rate payable to the destination network, not on the distance or number of borders crossed.
