It depends what steps you take to try to settle this out of court.
Offering to buy him out at market value would be optimal.
If you offer him a few thousand, the court may see this as some effort, but probably not enough.
If you can get 20% together, that would be reasonable i'd think0 -

That's not really good for you eitherHe could argue that you are living using his money, and actually ask for you to pay towards his rent. (as you are refusing to release equity) - that wont necessarily happen, but he can ask for it

Where di you the the 'value' from? if it's what you paid for it, then he's right to turn it down. But obviously i don't know what the value is, so 5k could be alot, or very little, in comparison.

He isnt here at the moment as police are involved and ive applied for an injunction as he hit dd2 weeks ago and he broke front door last friday, he has a history of violence, the house is worth about 70 so offered him 30,.0

Your problem may be he thinks its worth more, and you've not offered half of even that value. What's he asked for?0 -
He asked for 38 , and injunctions can take up to a month.0
