Hi all, to cut a long story short i am now divorced from ex husband and we jointly own a house no mortgage, me my dd 18 and ds 20 live here, dd is at college.
He is a violent bullyish thug and police involved, he is in court today for drink driving. He phoned me yesterday to say he is forcing a sale on the property and to expect a solicitors letter, we have tried to offer him money for the house but he wants ridiculous ammounts, it is pure spite on his part. What i want to know is i know he can eventually try and force a sale but will i be liable for the costs when he is doing this or do i just let him waste money, and would the judge listen to all circumstances or is it black and white.
Also since he has been living with his girlfriend who is on benefits and he was working even though he now has lost his job through drinking he was still using this address for everything but paid no bills ect towards the house, it all comes out of my account, would this be taken into consideration at all.
He has been thrown out by girlfriend all down to money so stopping with his brother who is another peehead.
Anyone help me please.

Before offering advice, we/I really need to know what the judgement of divorce said regarding assets.
Also is he paying child support for your daughter?0 -
Was the house mentioned in the divorce proceedings? Also I'd wait to see if his threats come through and then visit a solicitor.0

Hi thanks for the replies, the house wasnt sorted in divorce as we had both agreed that the kids could stay living there and a few weeks ago we did an agreement to say we wouldnt sell without kids consent which was witnessed by a neighbour and no child support either as dd 18 has part time job anyway.0

If he's a p!ss-head with no job how is he going to be able to pay the costs of bringing this potential forced-sale to court? This is not going to be cheap.
Still, it was utterly foolish not to get the financials sorted when going through the divorce. He own 50% of a fully paid-off house. It's not fair to deprive him of that, or some of it, even though your kids are almost independent.0 -
Yes it was very foolish and now its coming back to bite me on the bum, i just really need to know if he does force a sale and it goes to court am i liable for the costs at all .0

That would be up to the court to decide. What they could take into account is your previous attempts to reach an amicable settlement with your ex beforehand.
Still, it seems you might not have to worry about this for a bit. Not until he has secured some employment and then raised sufficient funds to start proceedings.
Meanwhile you're living rent and mortgage-free. Which he probably won't be.0 -
You'll be liable for your court costs, unlikly (but not out of the questio)n for his.
Also if your daughter is in full time education he should still be paying support. What about support for you?
Why did your solicitors not state an agreement re the hosue when you divorced.
I dont think it will matter if he said he wouldn't sell without childrens consent, he can change his mind0 -

Yep, and i think the court may take a dim view of this.
But the CSA might be interested in him too...0 -
