when i got a section 21, mine was not signed. and my local council told me they had to do another one. as without it in hand, its not valid. it will cost them more to take you to court. they will cave. and let you have the extra month. you could go to your local CAB. they probably get this all the time. it will hopefully set your mind at rest a bit.
i was handed another notice with a new date on. i then had another 2 months. i then found out a got a new house to rent. so couldnt stay the 2 months i was given. the letting agent then tried to get 2 months rent off me. the cheek! i have never known a agency care. i now rent off a family friend.0 -
So, start making it a nightmare for them.
Do not respond to their paltry offer of half your removal costs. In fact, do not respond to them at all for the time being. Make them sweat!0 -
That's what I'm worried about, if I dig my heels in and they start notice again, and then I end up being offered a completion date in 3 weeks will I have to pay the remaining 5 weeks rent?0
-
You can always give your own one rental-period's notice avoiding having to pay that second month's rent..0
-
That's true. Will wait and see what tomorrows call involves, she's ringing me back and putting complaint into EA!0

I'm not sure what my tenancy is, I've been here 2 half years I'm sure it is an AST. It was six months initially then I assume rolling now?0
-
Yep, you're on a periodic tenancy. Which requires that you give at least one rental-period's notice0

Brilliant. Feel better about the call tomorrow now!0

I may have missed this in the thread, but your notice (and the LL's s.21) each need to expire in line with a tenancy period. You don't just give a month's notice, to expire a month from the date of the notice (if that makes sense). So, what were the start and end dates of your original fixed term tenancy?0
