YEPS parking charge notice

Hi
I was hoping someone can give me some guidance on how to proceed. I received a parking charge notice from YPES ltd - They have ticked that the reason is Without a valid permit or authority. They have my car model wrong on the ticket but reg and date is correct. The place I parked is a very short alley 15 feet or so with the back gate of a business (always locked) in the evening past 8 pm. The alley is just off a cul-de-sac round- about in a industrial park with various businesses and the gym I go to.
I have parked here before a number of times and so do other people and I had never until yesterday seen any signs, markings , no entry signs or even private property sign. Only noticed a small sign on the gate yesterday after seeing the charge notice left on my screen asking to pay 60 pounds or 100 if I dont do it within 14 days. I am going to take some pictures of the place as it is also currently being used as a rubbish dump with a lot of old wood being dumped there.
The notice does say YPES Ltd adhere to BPA code of practice and that they are members of AOS. I couldnt however find them on the AOS website.
They have an email appeals procedure on their own website so I just needed some advice as to whether I should lodge an appeal on the grounds of insufficient signs/markings with YPES or ignore till they send a letter. I have read here that I could potentially send a short letter or email denying liability and asking for Popla code? What would be the best cours eof action? 60 pounds is way excessive charge for parking there even if it is private land?
thanks in advance.

Best wait and see if they contact you after getting the details from DVLA. Not being a member of AOS, I checked as well, they should not be able to. Come back then.
PS, what a cr ap website, must be a one man band.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0 -
If they claim to be members of a trade body when they are not then that is illegal & a matter for Trading Standards. You would need to contact the BPA to confirm that they are definitely not members as the BPA website is not updated in a timely fashion as members join & leave.0

Thanks. I have sent an email out to BPA to check if YPES is a member or not.0

They also pay a commission for self ticketing operations, isn't that profit?

This is normal for self-ticketing. See this contract between UKPC & Stoke Mandeville Hospital released under an FoI request. https://www.whatdotheyknow.com/request/154459/response/393359/attach/3/UKPC%20Contract%20Stoke%20Mandeville.pdf They pay 10% of all receipts as a backhander. In other self ticketing operations the PPC will typically pay a bounty of £10 to a resident of a block of flats who tickets their neighbours.photography wrote: »They also pay a commission for self ticketing operations, isn't that profit?0 -
Some of the wording on their website is very similar to that on the UKCPS website . The rest seems to have been lifted from a council website:-
Road signs. Any unclear signs such as suspended bay signs or residents’ parking signs.
Road markings. Any unclear bay markings or yellow/red lines.
Lack of signs/markings. Areas without signs or markings you believe should be there.
Your car. If you’re disputing where you were alleged to have parked, take a picture of your car and capture the immediate area around your car.
The meter. If you were parked in a paid-for bay, keep your ticket or take a photo of the meter if it still registers the time your paid-for parking expired.
Oh dear:- "YPES Ltd are British Parking Association ‘Approved Operators’. As such we undergo a rigorous yearly audit by external assesors.
I can't find them on the AOS list. And they can't even spell "assessors" (just like UKCPS!)What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -
They say they have electronic link to the DVLA?
They say they are BPA Approved Operators?
They say they will manage small sites as small as 1 parking space. Does anyone want to have them look after their driveway? :rotfl:
Standard charge £100/60, but can be varied to suit client! Genuine per-estimate of losses?
Pity they don't tell their client that they become jointly and severally liable for any legal action by motorists
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
