    I agree with this advice.

    However, ebay now insist on a refund policy of minimum 14 days.

    "You can specify the returns time frame and who pays for return postage when you create your returns policy. Please note that the minimum time frame for returns on eBay is 14 days. We've chosen this because a 14-day returns period will be required when changes to UK distance selling regulations come into effect in June 2014."

    They never cared about UK DSRs before now...like it'll make a difference. Ebay - the law unto themselves.

    You will find they will limit it when there is a nice 'established business' and some decent funding in the account.

    Perhaps you may want to leave this thread open for when the issue comes back, it certainly will be flagging itself sooner rather than later if you are already have disputes with customers.

    Probably, but i haven't had any disputes with customers as of yet, and I don't see why I should have any in the future.

    No. DSR do not give any power to the seller to insist that labels, tags or original packaging has to be intact. Nor does it say the item must be unopened.

    If such tags and labels are added in the process of manufacturing the item and not price tags etc added by the retailer, they may form an intrinsic part of the item and removal could make the returned item completly un-saleable. So while not specifically mentioned under the distance selling regs, you would obviously be able to take the person to court for damages and therefore you have every right to insist that all the tags and labels are intact. In other words the distance selling regs are not the be-all and end-all.

    Court Action may be applicable to any purchase/sale.

    But my point being the DSR are specifically there to protect the buyer.

    As a seller you cannot with-hold the refund, in fact you cannot expect the customer to return the item, it just has to be made available.

    So, the OP legally has to refund. Whether the item is saleable or not does not come into it, even if they come back in tiny pieces the OP is legally obliged to refund and will break the law if he does not. The duty of the customer is to take reasonable care of the goods whilst in his possession, that is all. It does not give that they should be 'saleable', 'as delivered' or any other stipulation.

    If the OP gets them back and finds the item unsaleable he may see if there is any legal action open to him, likewise if he feels the customer has failed in his duty of care he could try to regain his losses via Court.

    Your not going to get very far in business if you get angry with a customer.

    Your customer has missed the 7 day cut off for DSRs but going the extra mile and refunding customers like this could pay off in the long run with repeat business

    They are not necessarily going to be used. If they are returned in their packaging and have only been tried on then it's no different to buying new stuff in a shop which other customer could have tried before you.

    If the customer has taken the p!ss and there is wear and damage block them and move on.

    I thought the point of this thread was as a result of a 'dispute' with a customer?

    I am not saying they have opened a 'case', but if you are being as obstructive as you were showing in the opening comments, then you may leave the customer no choice but to flag your account.

    Since you have now opened a paypal account which paypal will consider fraudulent I would certainly not be drawing attention to myself by annoying buyers.

    I assume you are correctly registered as a business so will be expected to do that little bit extra for buyers.
