Buyer wants to return sunglasses..

    If you you are a regular seller or becoming a business, you need to write for yourself a default email you can copy and paste for this request which also re-iterates your terms, e.g. item must be in an unused condition and in the original packaging.

    You cannot insist that the item is returned 'in the original packaging' in fact you can insist on very little.

    OP. If you intend to trade as a business then you need to act like one.

    Accept the return and refund promptly when the item arrives back. Keep your customer informed at all times.

    As a business seller you will need to familiarise yourself with the distance selling regulations, where buyers have 7 WORKING days to notify you of a return.

    Tell your buyer to return them tracked for a full refund.

    Buyer pays return postage - you may want to add this on your auctions!
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    Hi there, you're actually right, the feedback is very important to me espically as I've just started out 3 three weeks ago.

    I will give them a refund when I get it, and I've told them to send it back tracked.

    The DSR say that an item can be returned if the buyer changes their mind but it must be unused and/or unopened. This only applies to a business and not individual sellers. So all the original labels must be still on (if it was new and not used)
    For sunglasses, this would mean the sticky labels should still be on the product and any other labels should still be attached. They should be in the original condition or you can't refund.
    M & S won't refund without the labels on.

    No. DSR do not give any power to the seller to insist that labels, tags or original packaging has to be intact. Nor does it say the item must be unopened.

    The seller can 'ask' for tags etc to remain intact but they cannot insist and they certainly cannot with-hold a refund on this basis.

    As the OP is a business seller, then he must comply with the law.

    Ebay business sellers have to accept returns back if buyer changes their minds.
    What if you change your mind?

    Distance Selling Regulations
    The Consumer Protection (Distance Selling) Regulations 2000 generally apply to sales to consumers made by sellers acting in the course of a business, which have been made at a distance. In other words, where there's no face-to-face contact between the seller and the consumer before the contract is made. The Distance Selling Regulations apply to items purchased via Buy It Now listings and Second Chance Offers on eBay.co.uk. However, they don't apply to auction format listings on eBay.co.uk.


    The Regulations also provide a period of seven working days after the date of receipt within which the consumer can cancel the contract (often referred to as the "cooling off" period) and get their money back, including the original postage and packing charges.


    The consumer can be asked to return the goods at their own expense, but only if the seller informed them of this requirement before the contract was made (otherwise, the seller is responsible for collecting the goods). If a business seller has not provided the information required under the Distance Selling Regulations (as discussed above), the buyer will have up to 3 months to cancel the contract and get their money back.


    The cancellation rights do not apply to certain items including software, audio or video recordings that have been unsealed, perishable goods such as food or flowers, or items that have been made to order.
