You shouldn't need to worry about POPLA. ASDA aren't stupid enough to mess with the equalities act, even if Smart parking are.
However, in the unlikely event that ASDA customer service has a brain fart when replying to your letter, you might take heart from the fact I have written 3 times to ASDA asking them about the contract they have with Smart Parking, and each time they ignore the question and answer some other question which I did not ask. Either they don't have a contract in place or they have secret clauses they don't want anyone to see.
If it comes to POPLA then, the killer line will be 'I do not believe that Smart Parking have a contract with the landowner to issue charges, pursue them to court and to behave in compliance with the BPA code of practice.'
POPLA have consistently upheld appeals on these grounds whenever the PPC failed to produce a contract.
Lastly, I have seen several Smart Parking POPLA evidence packs and they are without question the worst of all the packs I have seen, and that is saying something. I think the tea boy might be able to do a better job. Rest assured then that if it does go to POPLA you can be guaranteed a good laugh rather than being frightenedDedicated to driving up standards in parking0 -
I suppose you could write a letter to ASDA along the lines of-:
Dear ASDA,
There is a company called Smart Parking (or sometimes Town and City) going around telling motorists that they have an agreement with your company to collect money for so-called "parking infringements". When asked to produce proof of this arrangement (in the form of a contract) by an organization called POPLA, the parking company were unable to produce this contract.
So is this company legitimate, or are they using the good name of ASDA to con money off people? If the former, why don't they produce the contract to dispel any doubts about this so-called arrangement.What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -
I was in Inverness on Friday 7th June and parked at Strothers Lane -- I put £2.45 into the ticket machine with the intent of purchasing 4 hours of parking -- alas I did not notice that the machine did not take 5 pence pieces -- the machine woule not allow me to insert any more cash neither would it allow me to ejectr the £2.45 I had put in -- so I was stuck -- I elected to take 1 hour of parking with a view that this would be enough -- so the clock was running and I had to be back to my car at 1005 -- I arrived back at 1012 to find I had received a ticket for £90 discounted to £45 if I pay within 14 days. I think this is a tad harsh as I had £2.45 on the ticket (and I couldn't insert more cash or retrieve the cash I'd put in) and I only missed the deadline by 7 minutes.
I've gone on line several times to appeal the charge and I am told the PCN details cannot be found.
Any advice on what to do?0 -

HI, Coupon mad and Stroma i need your help! ive had to look all the way throught find this thread and i dont know if i should continue on this or start a new one. this is all knew to me. Ive received aletter from Smart Smart Parking to the letter above but i dont really understand it. Its short and the main body of the letter reads:
We confirm that yourappeal has been received and that all action has been suspended pending adjudication. We will endeavour to respond to your appeal within 28 days.
If your appeal has been received within 14 days of issue of the pcn the discount period will be extended should your appeal be unsuccessful. However, if your appeal was received after the discount period had expired the extention of the discount will be at the discretion of the adjudicator. yours......0 -

It's just an acknowledgement letting you know that they've received your letter.
