.....???
Hi
needing some advice regards what I would I may be entitled to with trying to keep a roof over my head.
my partner is preparing to move out of the house we share with our daughter soon and get her own home due to various problems between us.
I am currently on long term Incapacity and also receive DLA this will be the only money now coming into the property but the mortgage will still need to met.
from what i have read online I might be able to claim help through the SMI benefit but will it cover my predicament...I dont receive income support just now either??.... and if so what do they mean by old and new re waiting 13 weeks or up to 39 weeks prior to qualifying for help??
really worried as looks like i will probably lose the house without this assistance and end of god knows where??

hi princessdon
daughter 9...partner having child and no maintenance as im only in receipt of benefits,thanks0 -
From directgov website:
You must be getting one of the following benefits to qualify for Support for Mortgage Interest (SMI):- Income Support
- income-based Jobseeker’s Allowance
- income-related Employment and Support Allowance
- Pension Credit
https://www.gov.uk/support-for-mortgage-interest/overview
so it doesn't sound like you qualify as your benefits are not income-related - as things stand at the moment.
Maybe you'd do well to do a benefits check to see if you are eligible for any other benefits after your change in circumstances.
Try putting your details into here:

Normally, when a couple separate, the PWC stays in the marital home - might this not be the better option?0

As above
or you could arrange to sell the house and remove yourself of a liability to meet a monthly mortgage payment which you cannot currently (it seems) afford.
perhaps in the future you could then resume a mortgage when your circumstances are different.0 -

You will still need to pay £5 per week if she decides to persue maintainance from you.0 -
Sad that people are telling you to give up your house without establishing your entitlement
Unless the outstanding capital is very low, it is likely you will qualify for IS as a single person by virtue of having eligible housing costs. Contact the JCP and ask to apply for IS and to be assessed for SMI. Depending on what DLA you receive, you may not receive any payment for the first thirteen weeks, but then the housing costs will kick in. If you receive DLA MRC or HRC and no one claims Carers Allowance for you, you will be entitled to some IS now.
SMI is only paid on eligible housing costs, and at a rate of 3.63%. Eligible costs include the original capital amount, plus any borrowing for essential repairs to the house. It does not include product fees and borrowing for debt consolidation.0 -
You will need to sort out your benefits as IB is contribution based so you need to move to income based. Not sure on this procedure but others will advise. Once on income based as you live in the home you can claim SMI after qualifying periods.
Note that child tax will come under universal credit (this will be a changes in circumstances) so depending on where you live this could impact his claim as he will have an asset he doesn't live in, but that is his issue when and if this arrises.
You will need to start looking at being single, DWP routinely look at things like joint bills etc for separated couples so start looking to separate your finances when appropriate.0 -
when you say your partner is "moving out and planning on getting her own home".
Will she not be chasing you for a share in your current house? I am sure she would be entitled to a percentage?
is she going to get another house from the council? So she has one house paid for by the Tax Payer? and you are also wondering if the tax payer will pay for your current house?
Does this not seem a bit "greedy" to you?
The above is why the benefit system may look at your situation and consider it "contrived".for the benefit of the individuals involved0 -
As said, Ring up you can claim I.S on the grounds of your IB.
You may be entitled straight away if your IB is less then £102.70 a week you will get some benefit from the date of claim.
If you are in receipt of DLA middle care or above you may be entitled to more in the form of Severe Disability Premium and maybe Enhanced Disability Premium.
You would get help towards your mortgage if entitled after thirteen weeks.
I am assuming you have capital under 16k.
If awarded I.S you would also get help with your Council Tax.
So apply.....0
