But after the tenancy ends the landlord's remedies are purely contractual rather than proprietary. It's generally practically very difficult for landlords to succesfully sue for the last period's rent.
You could counter claim for non repayment of deposit.
It could be fun getting a reference out of him for a future rental though:). In this situation I would be on top of the landlord as he sounded a bit vague about the money. Really dont think your suggestion is useful in any way. how can you counter claim for non payment of seposit if you have in theory no money outstanding to you.

Because otherwise your landlord might not give you your deposit back?
I fully understand that you are not supposed to withhold your last month's rent in lieu of the return of the deposit. However, let's say you don't damage anything, the house is how it was demised save for fair wear and tear. In the absence of a statutory protection scheme for tenant's deposits (hopefully forthcoming), if I was the tenant and I thought the landlord might not repay, I'd be looking out for myself, especially if I knew that I hadn't damaged it.
If there's no damage he has nothing to complain about does he?
But I agree that this is not helpful to the OP whose daughter has already handed over her last month's rent, so let's leave the discussion on the topic there to avoid any arguments shall we?

Do you think they should choose a specific way for the return of the deposit or just let him decide?
Like my daughter paid by direct debit so did her friend but the other two paid by hand in cash or cheque
I don't think they mind that much so long as they get it back but is there a particular way that would be best or to avoid
I was a bit concerned about having a cheque because he could delay on it more or he might want to send it by post
They are writing a letter to the landlord from all 4 of themThanx

Cheques can always be stopped. If they're in the locality, cash would be best. If not, can you convince him to do a bank transfer?

Yeah they could try I suppose, more so the ones that paid by direct debit but they werent sure what to ask for in the letter. They could prob just put cash or bank transfer then and let him choose from that maybeThanx

Hmm.
My housing agency must be very dodgy..
- They sent us a letter of things we have to do before we leave the house..
This included: "using a toothbrush, clean all of the bathroom tiles and around the shower area" amongst other things!
I have to say though, the house was filthy when we moved in. We had to clean the kitchen, bedrooms and living rooms on the first day, so how can they expect us to leave it in a better condition than we found it in!?
Also- re: deposits. They said in the letter that it will take 11 weeks to return the rent, surely not? I shall be paying them a visit as soon as our tenancy is up and asking for my deposit back!0 -
I was talking to my daughter last night and she only just told me that when she first viewed the house there was a double bed in the room, she specifically asked for the room with the double bed in but when she arrived there was just a single bed in there which was a state. She had to buy a bed which she really couldnt afford as a student nurse. I think this was very sneaky of him to do that, he should have made things more clear to her
They have decided to all email a copy the letter to the landlords business office and ask for conformation that its been recieved rather than post it or take it in by hand as they are struggling to do that because they are on community placements in the day do you think thats ok?
I'm just a bit worried if it will rile him into being awkward about things and drag it out more. The is no mention whatsoever on the tenancy about a deposit. Her reciept does say deposit but not that it was refundable, it was one of those carbon copy onesThanx

I would err towards posting it Special Delivery. At least that way you can prove he's had it.
If at all possible - can they get to the PO on their lunch break - or could they email the letter to you and have you post it?
