cheque centre nightmare please any advice

    Of course they are entitled to it, it is their money, not yours.

    It is you trying to take from them, not the other way round.
    The replies are telling you the only way to secure your money is to prevent them having any way of accessing it, removal of cpa, a whole different account etc.

    No good getting grumpy, you are the one on the attack.
    Once you prevent them having any means of taking their money, they have no choice but to come to an arrangement.

    im sorry but how am i on the attack i dont get that i was just saying they had access to the money on friday due to wages not being changed over we offfered then 15o a week and they say thats not good enough i cant even pay my rent this week so i apologise if i came across as grumpy as you say im just worried atm as to where to get food etc .we have now arranged for mony to be paid into my account so they wont have access to it that will be done this week so his wages go in there etc as i sAid his boss didnt do it in time this week.he works for an agency n the agency pay his wage .tried to remove the cpa with the bank apparantly we cant do that but did tell them we wanted all money to be stopped from leaving acciunt they obviously cant do it as the moneys gone and cheque centre still hounding us for the rest as they want full payment on the four loans

    Who told you they can't do that?

    If you have told the bank that the CPA is cancelled then from that moment on any money taken (that is not already in progress) has to be refunded by the bank. That is a legal requirement.

    I suggest that tomorrow morning you speak to your bank's fraud department (not the muppets in the branch or the usual call centre chimps - neither of them will have a clue what they are talking about) and tell them that you cancelled the CPA (and the date on which you cancelled it) and therefore you require the repayment of the unauthorised debit.

    Hi it was the bank we rang them and said we was in financial difficult and wanted to remove the cheque centres authority they said we cant do that and the only way around it was to close the account and not use it .and they have let the cheque centre take all our money we rang them again yesterday and said we canceled it to which they said they had no record of it so couldnt help then either will try the fraud team tommorow thankyou xx

    Which bank is this?

    When you ring up again.

    RAISE A COMPLAINT. DO NOT LET THEM RESOLVE IT...

    This needs to go to the FCA, as you bank are out and out breaking PSD 2009.
    As such they deserve the big fine they will get.

    When you call. Its not the fraud. Its the disputes team you need to speak too.
    Just give them the date you withdrew your authority to the cheque center to take further funds. That will be the date you 1st called them to advise of your payment issues.
    You should then be refunded for any debits to them after that date.
    Again if they will not COMPLAIN. Just mention PSD 2009 (payment services directive) and you are contacting the FCA about their failure and also how the cheque center are not abiding by their obligations when a customer hits payment issues.

    Believe me I deal with these on a daily basis and your bank are in serious trouble. The FCA do not tolerate issues such as this.

    Yes. You do still owe the money. But neither the Cheque center of your bank should be treating you in this manner :mad:
    They both have obligations they have to stand by.

    It may well be worth while talking to the FCA now about failures by both parties to support you. UK: 0800 111 6768 (Freephone) Before you contact the bank.

    hi its the royal bank of scotland a single account in partners name a basic one aswell .thank you so much for that info will try them before the bank tommorow i hope they will refund as were in a mess atm seems to be no help anywhere for us .
    of course i no we owe the money i think they lack common decency and a heart but thats just imo
    hopefully we can sort this out xx

    Spoke to the bank branch manager explained to them we wanted to cancel the cpa said we cant so told them what i had learned of here to which he went quiet but still said i was wrong .told them that money i had asked to be stopped from leaving the account qnd they ignored my wishes so ive asked for there complaints procedure info to be sent to me and some one from the disputes team is going to call me back so waiting for that
    on another note all of our food has now run out surely the cheque centre cant take money if this is for essentials as i dont think i will get that money back tbh i no we owe them and am willing to pay but they took every penny :(
    also they told me to cancel a cpa it has to be done in writing and they have no record of my call either allthough there message says all calls are recorded for training puproses it doesnt make sense tbh i think the bank no they are wrong

    Keep a note of exactly who you spoke to and what they told you - once all of this is sorted, you need to let their complaints department and FOS (evein if RBoS resolve the problem) know full details - As dalesrider said, RBoS deserve a large fine for ignoring PSD 2009.

    have wrote down everything even time of call etc .going to wait for the person from the disputes team to call me back and see what they say

    Fact is if you told the cheque center before speaking to the bank. Then that is the date that can be used by RBS.

    TBH. talking to the branch is a waste of time.
    You need the account holder, unless your bank account is a joint one.
    If it is a joint account do not wait for them get on the phone now and chase them up.
