Vodafone Fraud please help me

Vodafone have extended my contract for another 2 years without my knowledge due to a marketing call from a third party company offering me an early upgrade..Vodafone claimed to have no knowledge of this call offering upgrade but gave my private information to another company against my wishes. they gave me the upgrade as a good will gesture but failed to tell me they were extending my contract..the handset is now faulty and i cannot use it theyre refusing to repair it claiming it has moisture damage which could be due to the climate, im now left in a fraudulent contract which they wont relinquish me from they have nothing from me to state i signed for this contract or agreed to it and theyre refusing to repair my handset, we have now reached deadlock and theyve signed the case off and left me paying every month until feb 2014 for a service i cannot use..please help:mad:

    Vodafone do not pass on your personal information. Vodafone only pass information onto associated services upgrades/sales/ LBM Marketing which are a third party dealing with upgrades on behalf of Vodafone.

    There has been no fraud or scam, you agreed a new 2 year contract and got your phone wet and it is now beyond economical repair.

    You can try Blackberry for a repair but you may find you will get the same response.

    The phone and contract are separate, you are still receiving a service with your SIM card, get yourself a cheap phone and put your SIM in it.

    You did agree a contract.
    Whether it was direct or through a third party makes no difference.
    You got your phone wet.
    Vodafone won't repair it.

    There is no fraud/scam here at all.

    Its common sense that if you get a new handset, you get a new contract to go with it. The only way you can get this sorted, is to prove that the handset is NOT water damaged. Alternatively, you can claim from your insurance as well for damage.

  • Vodafone have admitted they gave my details to carefone warehouse i had opted out of any marketing on joining vodafone, carfone warehouse told me they would send me out a new phone during a random call..it didnt arrive which prompted me to call vodafone who sent me this phone as a goodwill gesture...they then 3months later extended my contract by 2 years without informing me..the phone has never been near any water!!

    goodwill gesture and Vodafone,do not go together,
    all you have to do is look on this forum to work that out
    there or their,one day i might us the right one ,until then tuff

    Why would Vodafone want to give your details to a third party ?

    Vodafone have their own products and services to sell, it would not make business sense to pass details over to a third party.

    As part of the privacy policy, Vodafone only pass information onto associate services such as ugrades.

    Have you ever been into Carphone Warehouse and purchased anything ? Carphone ask for your details and add the information to their data base.

    I think you have a case for getting out of the contract if voda claimed they were giving you a new phone for free - essentially to placate you as you were very unhappy about your details passed on.

    If the phone was really an inducement to extend the contract or take out a new one, they should have made this clear.

    Forum posters know that phone companies are not so generous in these situations, but others may be more trusting.

    How strong your case was would depend on exactly what was said at the time. Get them to give you a copy of the phone recording - you are entitled to a copy under data protection.

    Also did they not give you a paper or electronic copy of the contract at the time?

    A phone can be damaged by water condensation under some circumstances. I've had that happen to me.
