    Just an update:

    I took the advice on here that I had nothing to lose - so I offered the buyer a partial refund based on the fact that item she returned was unsellable due to the condition.

    She immediately fined an A-Z claim with a email that described the item as counterfeit and even a leading high street seller has looked at the discs and confirmed they were pirated and she has compared my copy to the one in the shop and they were not the same. She stated that the box had been damaged but that was when she was comparing it to the item the shop. And it was only damaged because it was such poor quality.

    I told Amazon that I accepted she was not happy with the item and offered a refund based on that but it was only a partial refund based on the damage.

    A-Z have refunded the buyer but found no fault with me and so Amazon has refunded her themselves. So a good result for me but not for Amazon.

    That's a good result for you - I have my doubts that the one you got back was the one you sent out but these things are so hard to prove.

    Sounds like the buyer has managed to con Amazon out of the money, but at least you didn't lose anything.

    Yes. Sadly, I will not be able to re-list the DVD for sale - it is my belief that the item that has been returned is materially different to the one that was sent - but this is not provable by either party.

    I haven't lost out but there will be other people who fall for this - shame we can't give ratings for our buyers...
