So to challenge the PPC I do it through the appeal section on their site? I'm just not sure what to say

    What are you reading?

You seem to have only read old stuff here telling people to ignore even though we don't advise that now. And on pepipoo what did you find that talked about the driver? That's old too and no idea where you found it!

Current forum here, every thread discussing appealing these scams, read a few:

    http://forums.moneysavingexpert.com/forumdisplay.php?f=163

Current thread on pepipoo, every thread discussing how to appeal (ignore the court claim ones = rare):

    http://forums.pepipoo.com/index.php?showforum=60

You do have to be serious at POPLA stage. Please read CURRENT threads. All you do first is CHALLENGE the fake PCN but not an excuses 'appeal' about what you did.

I haven't yet received a reply from my appeal, is this normal? Or should I appeal again?

@Coupon-mad, it says on the peipoo forum
The PPC may "invite" (not demand, nor require) the RK to provide the details of the driver at the time of the alleged transgression. If the RK doesn't do so, or their invitation is ignored, the PPC is entitled to pursue the RK for whatever charge they are lawfully entitled to from the driver. If the RK does give the name of the driver, the PPC must solely pursue the driver. Therefore as long as the PPC goes through the correct process, relying solely on the argument that "I was not the driver" won't help you. However that is the only change, and if the decision is to ignore then it simply means that the RK ignores rather than the driver.

By way of information I suspect that the sign the OP has described is an old style Town & City Parking one that was not updated in line with the BPA requirement which was over 2 years ago. At that point many - I'd venture to suggest that it was actually most - T&CP signs described their invoices as penalties. Numerous complaints were made to the BPA who slapped T&CP on the wrist for daring to expose the golden goose's rear end and then generously allowed them 12 months to correct the signage. Looks as though this one slipped through.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com

The pepipoo forum just says 'IF you ignore' (which is still an option of course) but more recently has not become the standard advice on here. Both on pepipoo and here we prefer to say appeal and then win at POPLA (with help to word a legal challenge appeal).

Surely you have only just sent that appeal? If so then you are just waiting but can spend the time usefully reading up on POPLA appeals.

They should reply within 35 days and should then give you a POPLA code. Read up on good POPLA appeal wording in preparation, such as discussed on here:

    https://forums.moneysavingexpert.com/discussion/4621093

    and here:

    http://forums.pepipoo.com/index.php?showtopic=78520

...to pick out two of many threads on both forums talking about POPLA appeal points. Also read the 'POPLA decisions' thread near the top of this forum, to see successes.

That will be something I can put on my POPLA appeal can't it, that their sign is out of date with misleading and confusing information?

@ coupon-mad - 35 days is it? No doubt I'll get another letter by then saying the 'fine' has gone up but ah well. I received the letter and replied with an appeal on the 23rd so thought I might have heard something on the Friday or today considering how badly they must want my money lol maybe they're too busy conning other people.

I will do, I plan on taking some time to write down some points, thank you

So you can assume they have accepted it then, as long as you are certain your appeal went to the right place. IF you eventually hear from them against do post back here.

Enjoy the Summer weather and forget about it for now. :)

I can assume that town and city accepted my appeal? I'm pretty sure I wrote some one sentence crap like they're signs don't conform to the BPA code of practice. Maybe they read that and agreed lol

You're entitled to assume they accepted it if you didn't hear from them within 35 days. Maybe they read their own signs and realised they still used the 'P' word!

I have a photo of a ticket machine at a hospital car park which still carries the 'P' word. I'm saving it up until someone posts here about that very hospital! In the meantime scammers, have fun trying to figure out if it's you! :rotfl:
