good, the more people complain about these things the better, also try any social media outlets as well - make a fuss about it.
dont expect them the understand the issues, even PPC foot patrol staff dont understand - just make sure that its registered as an official complaint.
a few things that may help:
the charge is disproportiante and its clearly a penalty - private companys and individuals can not issue penaltys under UK contract law, they can only sue/charge for any genuine losses
As you were a customer, you spent money in the establishment, and as the car park was ( probably ) not full there was no loss caused by your stay - therefore no damage caused, no money due.
Print off a pepipoo flyer, ask the manager if he can display it on the comunity/local board (if they have one) in order to alert other people of the sharp and un ethical practices of their contractor.
Ask them what they are going to do to prevent this from happening again, sugest covering the anpr cameras with a bag.From the Plain Language Commission:

These POPLA appeals turn on the evidence the motorist gives so you need to include:
- the lack of legal status of CP Plus to form contracts or offer parking here;
- the lack of compliant contract with the landowner;
- the signage being pants;
- cameras not being maintained/checked as required
- breaches of POFA (Protection of Freedoms Act 2012, schedule 4);
- breaches of the BPA Code of Practice (read it!!)

and compare 'everything' to every paragraph in this, the BPA CoP:

and look at this too:

Spot the differences and you are halfway there.
Also read the 'POPLA decisions' thread at the top of the parking forum; gives you an idea of what wins recently and also shows you that a winning challenge may well have NOTHING to do with what happened on the day of an incident!

Thank you for your time, i shall draft something up for teh POPLA appeal and post it on here to see what you think and what else i should include0

I also have a ticket from CP Plus. I don't see that I have any grounds for an appeal via POPLA, and I doubt I have the time to go through the rigmarole of it. I will almost certainly ignore it as I have with other tickets I've had from Excel etc.0

OK if you really have no time to copy & paste two emails or letters, then ignoring is an option as long as you do so with your eyes open as to WHY we now suggest appealing, and to the remote possibility of getting a sudden sneaky small claim in a year or so. Things have shifted a bit in PPC World so we've shifted more.
Start your own thread if you want to discuss the options and why we say what we do now. Wouldn't want someone to think ignoring is the right thing unless they've considered the facts - ignoring is no longer the easy option, POPLA is IMHO. 'No grounds to appeal to POPLA'? LOL, dream on!!!!!!!!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi everyone, I have one of these CP plus tickets from a roadchef site. I got it just before all my exams and kind of forgot about it, but now the fee has gone up to £120 :-( I know I can appeal but I don't know where to start!
I was just getting ready to face up and pay to get rid of them but maybe it is worth a try.
Basically I was driving back from Devon on a university trip and stopped for a rest, I ended up sleeping for about 8 hours in my car as I was so tired and completely didn't think about the parking charge :-(
Anyway I am frankly a bit intimidated by the letters as £120 is a huge amount for me being a student, money is certainly tight!
I'm reading all the links that have been posted and I guess I will email them...0 -
If, after reading the links, you still have questions then please could you start a new thread so advice can be tailored to your situation."The darkest places in hell are reserved for those who maintain their neutrality in times of moral crisis." - Dante Alighieri0
