Fair comment about ignoring and that remains a valid tactic as the chances of a Judge ordering you pay out still remain low, but a well put together POPLA appeal will kill these tickets off leaving the scum with no option but to cancel the ticket. Not everyone likes to put up with letter chains as they do intimidate some people in the manner they are designed to do, as does the new tactic of issuing court papers. I have no issues with ignoring as a tactic, but POPLA is a far better option as not only does it stop the scum in their tracks, but it costs them as well!0

Well...court action isn't exactly free is it???
In fact iirc it will cost them £30 to file the initial papers [more than the popla charge]....:)0 -

Fair comment! I was really alluding to the ticket being killed dead long before then, it is obvious a lot of good people are intimidated by the threatening letters & just pay up. Ignore is still a valid tactic if you happy to ignore the treat-o-grams and are happy to accept the small chance of court, but I just think POPLA is a better one to kill the ticket dead!0 -
I'm afraid your advice is completely wrong and outdated.Computersaysno wrote: »... AFAICR there's no-one that has said 'I ignored letters, got ct papers, listened to all advice from here/pepi wrt a defence and still lost'...unless you know different?
We should be offering posters the options and letting them make up their own minds...[not everyone wants to be a crusader for anti-PPC actions, most just want the easiest route to avoid either hassle or paying].
Since Feb this year, I've now written defences for over 30 people who have had court claims and posted on Pepipoo, and they are nearly all people who ignored everything up until now.
Many of these relate to tickets going back 2 or even 3 years. The PPCs are now churning out hundreds of claims weekly (we only see a small percentage on the forums), and many people settle them because they don't want the stress or hassle of a court hearing, however remote the likelihood of it proceeding all the way.
The easiest and most hassle free route is now to appeal to the PPC (on any grounds, as long as you demand a POPLA code), and then a properly worded appeal to POPLA, virtually guaranteed to get it quashed. And removes the possibility of it coming back to bite you in a couple of years' time.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.0 -
Hi guys, I've received a reply, so now I need advice in how to word my appeal to POPLA.
A couple of things that may help, I usually pick up my partners disabled mother in the van but can't remember if she was in the van that day (cough) and can't tell from the picture they took with the cameras.
Any help with this most appreciated...
Here is there response
Dear Sir,
Thank you for your correspondence concerning your Charge Notice.
This PCN was issued legally and correctly according to the British Parking Association Approved Operators Scheme.
The amount of this charge is well within BPA guidelines, and all drivers entering this site agree to pay the advertised charge if they do not pay the required fee for extended stays.
In light of this, on this occasion, your representations have been carefully considered and rejected.
We can confirm that we will hold the charge at the current rate for a further 14 days from the date of this correspondence, after which the full amount will be due.
Yours faithfully,
CP Plus Limited
Although we have now rejected your appeal, you may still have recourse to appeal to Parking On Private Land Appeals (POPLA), an independent appeals service. POPLA will only consider cases on the grounds that the Parking Charge exceeded the appropriate amount, that the vehicle was not improperly parked or had been stolen, or that you were otherwise not liable for the Parking Charge.
To appeal to POPLA, please go to their website and follow the instructions. If you would rather deal with this matter by post, please contact our appeals office and we will send you the necessary paperwork.
Your POPLA reference code is xxxxxxxxxx (blanked out)
Please note that if your appeal does not relate to the above criteria or is rejected by POPLA for any reason, you may be requested to pay the charge at the full amount and will no longer qualify for payment at the reduced rate.0 -
Don't waste time telling POPLA 'the story', it will guarantee failure. The PPC needs to be nailed on much more technical points. Here are some examples:

http://forums.moneysavingexpert.com/showpo...mp;postcount=20

Use as many of the points contained in the above that apply to your case.
Also, have a look at the examples of cases that have gone through POPLA and understand what is essential to include for winning appeals and what not to replicate in losing appeals:

And for some light relief, but containing some very important messages, have a look at the Parking Prankster's blog:

I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

If you passing by, try calling in be polite, be firm, and dont let them fob you off.
if not then theres the customer service chanels, as well as social media - do tey have a prescence on facebook? again be polite be firm and dont let them fob you off.
the more people complain about these pakring parasites to the site owners the better, as the site owners need to see them (ppcs) as a problem - not a solution. From the Plain Language Commission:
