    POFA requires that in order to make use of the provision to pursue the registered keeper (if the driver does not pay the sum demanded) that they must send a Notice to Keeper within 14 days (counting the day you parked - 24 April - as Day 0) - para 9, Schedule 4, Protection of Freedoms Act 2012. From that perspective they have failed and should they persist in chasing you for the debt (as the keeper) they may be liable to a claim of harassment.

    As members of the British Parking Association Approved Operators Scheme they have also failed to comply with the Code of Practice and to top things off have made, arguably, improper use of DVLA data which is implicitly supplied to enable APCOA to follow the law.

    That should be an email of complaint to: [EMAIL="Steve.C@britishparking.co.uk"]Steve.C@britishparking.co.uk[/EMAIL] and then one to [EMAIL="elizabeth.symons@dvla.gsi.gov.uk"]elizabeth.symons@dvla.gsi.gov.uk[/EMAIL]. Make sure that Steve Clark at the BPA is copied in to your complaint to the DVLA.

    Counting the day you picked up your friend from Luton as Day 0, how many days passed before you got the notice to keeper from APCOA? More than 14? If so follow the advice further up this thread and get an email off to the BPA and the DVLA - email addresses and suggested content above.

    I've picked up yet further details of APCOA losing the plot over time-frames with the keeper receiving the NtK some 63 days after the event!

    Hello Umkomaas. I have taken your advice and started my own thread, just to be certain I get help pertinent to my own situation, however I cannot use the 14 day time frame rule to get out of this Parking Charge Notice from APCOA at Luton Airport - they have obviously got wise to that dodge ! ha ! ha ! I was not actually parked, merely pulled over into the layby to take use the mobile. I was not there long, as can be seen from photo 2 to photo 3, where my car is moving forwards to pull back onto the road. I thought that was permissable in as much that I know it is illegal to use the mobile on a road and you are encouraged to pull over to do so, and I thought this was a public highway, ie only the Police would enquire as to what I was up to. Please advise. Thank you
