Student in need of help with ntl!

Hi there.

Back in September we (myself and 3 housemates) signed up with ntl to their premium 10mbit internet package, and the guy told us that although they no longer did shorter contracts for students, he was "fairly sure" that they'd terminate the contract early, without penalty.

Now, it's coming to that time of year where students nationwide are thinking about moving out, and what do they say? "No we don't do that, you'll have to pay the remainder of your contract"... Obviously, I should have got it in writing, signed, sealed, etc. from the sales rep that they'd terminate it without charge! At £37/month it's not a cheap mistake!

My question is this: Is there any way we can get round this, or is the only way to reduce the internet to the cheapest package and just pay it? I'm sure we're not the only ones in this situation, and it's not going to look good on ntl / Virgin Media if they continue to do this.

    Unfortunately a sales rep word wont stand up much on the paper contract you've signed. Have you checked the contract to make sure on the term you've signed?

    Dont think you'll have much option but pay off the remaining months of the contract

    Yea it's definately 12 months. Oh well, I guess it'd be best to get them to change us down to the most basic, cheapest, package.

    I guess this is a way of them trying to get out of debt!

    From their T&C.

    " unless you are told otherwise by us, you must keep the phone service, the television service and the broadband service for 12 months from the service start date in each case and, in the case of other services, for at least 30 days. We may change the minimum period for any service but this will not affect you if you have already subscribed to that service. "

    As you signed up for the £37 service for a year,they may not allow you to reduce it to a lower package.

    Also if you change the package they might commit you to another 12 month term!

    Well, they've reduced us down to the lowest package,and there will be three months left of it to pay.

    Last year they did student offers, but they seem to have stopped doing them now.

    If you can prove your moving house, and your moving to somewhere that doesnt currently have NTL services, then they'll cancel the contract as its their fault not yours.

    So if your all going home, then use the website with all your home address on to see if one isnt covered. Then use that when saying your changing address.

    I wanted to take NTL with me, (student and got it inseptember) but they dont cover my new area so are cancelling without charge and I'm getting Sky instead.....

    ^^ that's exactly what i was going to suggest. they don't penalise if you move out to a non-ntl serviced area.

    Ooh I did not know that. I know that three of us are already with ntl, so hoping the other guy is with TalkTalk because of not being able to have ntl!

    Did you actually sign anything?

    As i am always wondering how when these companies promise things on the phone it doesn't seem to be legally binding when they 'change their minds/claim no knowledge of it/lie' several months later. Yet if a customer says 'ok' to a 12 month contract on the phone, that somehow stands up as gospel.
    Does anybody know the legal ramifications of this, as surely they can't have their cake and eat it?

    Yeah signed contract.

    It's gonna work out at £13.50 each extra because they've changed us down to the cheapeest rate.

    With the changing of address, they now offer internet when not in a cable area over BT lines apparently.
