hi all
i was given a 30 day consultation period as my employer said they are restructuring the business and my role is being made redundant after 12 years.
they said that i can apply to other jobs if i want to, they gave me a job description of a position that they were advertising the next day internally and externally.
the job is what i do with 2 more things added, can an employer do this, also the job title is different
many thanks

think it's ok legally as long as its a different job. schools that become academies do it routinely to shed older expensive staff then recruit much younger ones!
do you have a union? or does anyone else they will look into it.0 -
hi many thanks for the reply, they said they was reorganizing the company and are taking my role and combining it with another role yet they are advertising it externally.
also 90% of the role is what I do, I even asked at a meeting with HR yesterday “do I have to train the new person to do my job”, HR said I will not have to train someone to do MY job.
Surely she has admitted it’s my job.0 -
An employer is duty bound to make an effort to find you alternative suitable employment within a company if possible even if it means some additional training. The fact that they are advertising a role 90% similar to yours which I assume you could easily do with some training is on dodgy ground. Make sure you appeal against the redundancy. Go take advise from an employment solicitor. If you have a half decent home insurance policy it should cover Family Legal costs, they may take the case on if the solicitor thinks you have good grounds. This happened my wife twice in the last 5 years.... Both times the employer had to pay out essentially a year of her salary with negotiations. No employer wants to go to court. They always rely on you just giving up as taking a case against them can be expensive... If they know you have backing and are willing to persist they will either re-consider or pay out.. Not condoning a compensation/claims culture, it's just I believe employers should not be aloud to ride rough shod over their staff to save a few quid and when the redundancy is obviously not legitimate..0

hi
i had a meeting with the hr and my top boss asking why i wasnt offered the position, they said that they wanted someone technically minded, i asked why wasnt i offered the job with training as the top boss asked me 3 1/2 years ago to move from a buyers postition to this job as he said then " i was the best person for this position after someone left" i then accepted the position.
he coundn't answer this question regarding training just kept saying they needed someone technically minded for the role.
i have just taken a weeks holiday which has been pre booked from january and have found out that they have been interviewing people externally for my role with a technically minded person.
i have stated to them that they are reorganizing other departments yet no one else has been made redundant only me, they said no one else needed to be made redundant.
i am due another meeting on the june 12th as they have not found anything else for me within the company yet, i have been there 12 1/2 years and i feel that i am being singled out, could this be the case.
many thanks0 -
I would try to negotiate a settlement, if they obviously don't wish to keep you but might be on slightly dodgy ground. Have you tried speaking to the CAB, a union, or a solicitor who offers a free half hr consultation?0

What's a "technically minded person"?
What sort of person are you?0 -

I do not think you can conclude that there has been any such admission. Because you won't be asked to train anyone, if anything it is more like confirming "your job" isn't going to exist.0 -
hi they said they need a person with a mechanical background to do the job and as i have not got this they said my job would be made redundant and they will offer it for someone outside the company.
i have been in this job for 12 years and have been asked by several managers to do several jobs within the company ie purchasing, run campaigns, shop floor production, stores, warehouse, stock takes, internal auditing so in concerned why i have been singled out with all the help i have given others0 -
If you do not have the skills to do the new job ( the mechanical skills) and your old post has become redundant and you are the only person in that post then sadly you are the one who gets made redundant.
Are other posts affected?
Did they offer you any training to do this new job or is that impractical?0
