DLA Advice

Hello
could anyone help me:
I have applied for DLA once already.
I have four bulging disks, Nerve pain in the back and down the legs, similar to Sciatica, (but not) painful to say the least.
I have also got a crumbling and curvature of the spine, which are all very painful.
I have also had a disk taken out as popped out and calcified
Some days I can walk and others I cannot move an inch. Other days I am able to walk, but there isn't to many of those days
I am now very depressed and its getting worse.
I am on so many tablets it unbelievable.
I also forget things very easily probs due to the morphine!!
Anyway I applied for DLA , as I cannot hold a job as it is my pain is so temperamental and I fear of just getting the sack for not turning in etc.
I got turned down and I was very disappointed.
They had access to my medical records which shows all my tests and MRI's and operations
I have not job and my husband cares for me so he has to get lads working for him!! and we are running out of money fast!!
Is there anyone out there can help me as I don't know what else to do.
I am at the end of my tether, and my hubby and children are struggling to.
Any help will be a bonus and thank you in advance
P.S I am not a scrounger I have worked all my life and I did enjoy working.

Firstly DLA is NOT awarded on the medical condition(s). DLA is awarded on your care and mobility needs. You have to show that your care and mobility needs which arise from your medical condition(s) are enough to be awarded some level of DLA.0

Its basically if I need help with my mobility?
I wondered how people got those new cars!!
Do you think I should explain to the DWP that I was slightly confused about the whole application?
I thought it was if you was unable to work!! a very blonde moment!!

You have a month to appeal the decision by filling out a GL24. It is worth explaining that you didn't understand the process and if you can now show that your care and mobility needs may well satisfy the DLA criteria then you've nothing to loose.
People get "those new cars" by giving up the higher rate mobility component of DLA to a company called Motability.0 -

thanks guys that is a real help, I did say I wasn't happy with their decision and they had someone else look at it, and they came up with the same answer.
So where now a tribunal? I am not sure how long you get for this but I am pretty sure it has now run out. I will dig the letter out today.

You are not sounding too disimilar to how mine started. Have you filled in the form correctly?
You have to divide it into several sections (the grounds you are claiming). Health, treatment, prognosis, future and care needs.
You need to be able o really start at the beginning, in fact before the beginning. What you did prior, how active and ealthly you were.
Then how your condition started. How long or short was your treatment, how often you are treated. How often you are in hospital. Your meds, why they are given, the advisory sheet and how they effect you.
Prognosis, are you going to get better, what other treatment options? Side effects?
Then care needs, who looks after you, how, do you go out? Right down to can you put underwear on unassisted, then other clothes. Left on your own, social life. The list goes on.
My DLA form was over an inch thick. I sent in every letter, copy of prescriptions, supporting letters from Docs, other HCS, relatives, friends and mother Theresa! (Joking about the last one)
Information is King. DLA, is most certainally not the answer to a hostage of money. It is something you have to use to pay for those extras that allow you to work and deal with your disability. From the research I have seen they are turning a lot of people claiming DLA down or put them on low short awards if they don't work (this excludes kids of course)

Whether or not you appeal, you can also reapply. Take your time with the forms and get all the help you can to fill them out.0

If ever there was an advert for the transgression to PiP. you just made it. It's so expensive to maintain a car? Granted, it isn't cheap. You have difficulties in walking without pain? Having gone the extra mile with bone cancer in my femur for a lot of years and now totally minus my right leg I think your definition of 'pain' may fail the tests somewhat! No wonder that the benefits system and those on it are under the microscope.DLA is a difficult one. I got the Social Services out to assess my wife. They put me in touch with the Welfare Rights from the council (they only deal with people that are referred to them by social services so it is a back door)
They did everything help filling the form out, getting all of the evidence for us - my wife was given high care.
I'm going to have them see if they can get me DLA as well. Have difficulties walking without being in pain. I would like the higher mobility if possible to get a mobility car. It's getting so expensive trying to keep a car on the road today.
We are keeping in touch with Social Services as we will need them when this PIP comes in.

Having pain is a personal thing. So what is wrong with going for DLA? Many people I know on our estate have it for a lot less difficulties than I have. I would say that 20% of all cars on here are mobility ones. If you don't claim, you won't know if you are entitled. Besides which the Social Services are excellent at giving good reports to the jobcentre.
After also reading your comments on the other forum regarding claiming ESA and now this is sounds like you are a classic know how to play the system claimant.0
