Ah! Basically, it is not a change of contract. Nor is it overtime. It is a threat.I gave the facts, theyre expected to work Saturdays now because the company deem the figures not good enough. There will be no time off or extra pay for this. Thats the basic facts, there rest is irrelevant. It doesnt matter who the company is or what business theyre in. Is thats whats wrong, because I havnt replied to your PM asking who the company is?
What they should do is ring up customers on Saturdays and P them off no end with the harassment to place an order. Make the results worse in the week where they work Saturdays. That will soon result in an end to this experiment.You might as well ask the Wizard of Oz to give you a big number as pay a Credit Referencing Agency for a so-called 'credit-score'0 -
I skipped the 2nd page but the contract doesn't seem water tight to me, it seems to be worded so the employer and employee are 'fair'
You work 35hours Mon-Fri but addtional hours may be required...time to time...
I think thier is a differnerce between just stating additional hours may be required to...time to time. Every week is not time to time...its a set addtional day to the contract..could it even be argured that 'extra hours' doesn't mean he should be working an extra day as he is contracted Mon-Fri?

I think the contract stating extra hours but also stating mon-fri is confusing, as the above poster has stated, extra hours during the working week may well occasionally be required without pay under the contract, working on a non week day is probably arguable as not compliant with the contract.
I am afraid, as an ex union rep (railway for 15+ years) it's usually those in a workplace with no union representation who suddenly start seeing the benefits of being in a union when it's too late.
If you work for a large organisation and have no union then you are vulnerable to unfair practices like this.Unless specifically stated all posts by me are my own considered opinion.

I wasnt going to post again but I dont want to be rude and not thank those who have been helpful.
I must admit the wording did get me thinking last night too. Yes he signed the contract but it was never expected that those extra hours would be on a weekend and for the contract to specifically state Monday to Friday to me should mean any extra hours would be confined to those days. Hes quite happy to work extra and indeed does already, he left the house at 6:30 this morning.
For those still insisting on nit picking, not once did I say they were physically altering his contract and nor did I say he would only be working Saturdays from time to time. I dont know how many times I need to say it or how clear I need to be but he is expected to work Saturdays to improve the already good figures for the current climate. The figures will never be good enough for the company despite him achieving bonus for good figures. He will not get paid for the extra time nor will he receive a day off in the week for this extra work. I have not been obtuse, I have stuck to the facts and provided the relevant information where requested. The name of the company or the service it provides should not matter.
The figures cannot be made worse during the week because innocent customers would suffer and that is unfair. This is not a retail company so they are not taking orders. Really ive said that till im blue in the face too.
As for expecting a bunch of strangers to tell me how to tell a child his dad hasnt got time to spend with him, it was a rhetorical question. Some of you cannot even listen to what im saying never mind a confused child.
I asked for fact and thankfully I have been given some now by people who dontfeel they need to express their opinions on other peoples lives. Yes its a public forum and I open myself up to that but arent we all adults?????? Can someone not just ask a question and have someone answer it without all the nastiness and digs?????0 -
I had this on an eariler thread when I was asking about a maternity leave question. Some guy was basicly trying to annoy me and go against everything I was asking/saying. (I think it may because I offended them on a dif thread but another story
)
I think sometimes its best just to ignore the silly posts/unhelpful crap and just reply to the people who are trying to help...it also keeps the thread on track. I just turned round and said Im not arguring anymore and he posted a couple more times and didn't come back cause no one was replying to him lol.People don't know what they want until you show them.0 -
Youre right, I guess I expected too much in the form of basic manners and niceness. I suppose it would be a boring world if we were all the same. I expect people to be helpful because if I can help someone I will but were not all alike are we. I shall rise above it

Does the contract preclude working weekends? Probably not
What constitutes 'from time to time' is really where the problem is, for me that would be 2 or 3 times a year maybe.
There's only really a couple of things that can be done and you can really only judge which one is the best route to take by knowing what the repercussions are likely to be and whether or not they are within your risk window.- Face them down and flatly refuse
- Offer to do a few more hours through the week instead
- Offer to do a Saturday every couple of months or so but no more
- Leave
It's impossible for others to get a feel for the likely outcome of anything that he does.
Is it company policy or just one manager that's decided that the extra days/hours are required?
I'd maybe start with asking for the request for the extra hours to be put in writing, not sure they'd be forthcoming with this though.
Apologies if I've gone over things already mentioned but I can't be bothered to trawl though all the irrelevant rubbish that's been posted by some - either for nosiness or just to be pedantic.0 -
Thank you for your post. You havnt actually missed much by not reading all the posts but youve saved a few minutes you could never get back

The contract doesnt mention working weekends at all, neither to say they will or wont enforce it in future.
Its difficult to know how far they will take this. Its a new high up manager thats trying to bring this in. He already does extra time through the week by going in early every day but thats his choice and hes happy to do that, says he can get a lot done before the other come in which is fair enough. I know its reasonable to offer to do the odd Saturday but my gut feeling is it wont stop there. This company has had people bow down to its demands for years and despite people trying to take action they have always been unsuccessful because theres far too many people involved to get everyone singing from the same hymn sheet. I think at the moment all that can be done is sit tight and make excuses about not being able to work Saturdays and see if it wears off. If they do start taking action then we will seek legal advice but this company is known for walking all over people despite the legalities of it because people feel lost in the massive sea of workers and that despite everyone being in the same boat feel like a lone voice.
