Im posting on behalf of someone else so if I need to post more details let me know and I will endeavour to get all the details.
If someone is employed by a large company who exists throughout the UK and is salaried and works 37.5 hours per week as per contract but actually works more through choice can they be forced to work Saturdays. Basically the company is now saying the employees need to work Saturdays if the business is struggling. This only applies to middle and lower management, the higher management wont be working. There is no extra financial reward and the employee does not want to work Saturdays as has a family and prefers to spend his 2 days off with his young child. Can they be forced to work the Saturday aswell?The company isnt struggling and they most certainly arent folding. This is a massive company who just want more and more from their employees and customers. I wont name them but trust me if I did not one single person would stick up for the company.
He doesnt want to be paid for more work, he wants 2 days off per week to spend with his family, is that really too much to ask for? I understand some people arent that lucky but he doesnt need to earn more money and much prefers the free time.Yes its my child too. Whether you saw your dad or not is nothing to do with this situation. Our jobs were planned specifically so we could be there for our child, that was our choice. Is it really so bad to want to be there and bring him up ourselves? Why are we even being made to feel its wrong to want to be a family who spend their weekends together? We earn our money and we dont claim benefits other that the child benefit everyone gets. We work the hours we need to to survive and if we needed to work more to earn more to live we would but we dont so why should we?
I asked for advice on a work issue and somehow this has turned round to people questioning my family life. If people chose to work weekends thats fine, its not wrong for them but its not what we want. I wish id never bothered asking now because some people just cant keep the personal stuff out of it. I wanted facts, not to justify our life choices.

If you ask for advice you really need to give accurate information. You could have said, at the outset, 'my partner' or 'my wife' or 'my husband' or whatever.
Has he/she joined a union yet?
Because when all (or many) employees ARE in a union they have collective bargaining power. When a company is trying to force a change in contracts with which the employees are not in agreement then the Union can, and will, negotiate on their behalf.

Yes I did mention them but only to demonstrate why he didnt want to work saturdays. I didnt ask for opinions on what we should and shouldnt do with regards to how our time is spent.
Who can refuse what?
I gave the facts, theyre expected to work Saturdays now because the company deem the figures not good enough. There will be no time off or extra pay for this. Thats the basic facts, there rest is irrelevant. It doesnt matter who the company is or what business theyre in. Is thats whats wrong, because I havnt replied to your PM asking who the company is?
Anyway forget I even asked, I cant be bothered anymore.0 -
I think the key point here that should have been answered straight away is that the contract appears watertight. On that basis the only person who can advise is a specialist employment lawyer.

Get this it is OVERTIME as you put it now and yes they can be made to do it as per the contract as you say its not going to be every week like we were lead to believe when you said the working week was going to be 6 days
I can not even imagine what kind of company can make more money if the staff are working for free. Must me sales or some kind of production therefore cuttings the cost of the product.

But your lifestyle choices ARE relevant - because your partner doesn't want to work on Saturdays.
If he was happy to work on Saturdays then that's what he would be doing.
And the 'be grateful you have a job in this day and age' people (and I am NOT one of them) haven't joined in yet!
All the employees who are unhappy about this enforced change should get together and join an appropriate Trade Union (preferably the same one) who can then negotiate on their behalf.
But then, I'm old school and have always been in a trade union.
And, as they have supported me in the past, I am very glad I did.

I'm sorry you were subjected to that New Start. I fail to see how the frequency with which AP007 saw his or her father during childhood has anything to do with your question.
As I understand it, the person on whose behalf you are writing is contracted to work 35 hours between Monday and Friday, and already voluntarily works more than this.
It would seem this person also sticks to the terms of the contract by working additional hours "from time to time" when asked to do so.
To me, the key phrase is "from time to time". Working every Saturday is much more than additional hours "from time to time". It's a major change to the whole contract.0 -
