Swapped a phone under contract, now it's broke!

Hi all!
My husband has a contract with 3. When he first signed up it was with an iPhone 5, however after a few months he wasn't getting on with it, so he swapped it on Gumtree for a Samsung Galaxy Note ll.
last night when he plugged it in to charge it was fizzy and burning and the end of the charger was burnt! Contract is only new, from December.
My question is: Are 3 under obligation to change this or will we have to go via Samsung?

    Why do you think 3 would repair or replace a handset that they didn't supply?
    If it's still in warranty your only recourse is Samsung-however, are you able to provide proof of 'purchase'?

    Neither. He is on his own. If it is just the charger, buy a replacement for around £3 online.

    If the phone itself is faulty, take to an independent shop. You have no guarantee so a manufacturer repairer would charge considerably more, unless you have the original receipt for the swapped handset
  • Are sure the Samsung wasn't water damaged?

    Check on the internet to see if there are any similar issues. There is a chance this might have happened to someone else.

    Gumtree seller is responsible .


    Chargers are under a more limited warranty that may have expired .


    3 are under no obligation as you bought a network contact and they never supplied the Note anyway .

    Samsung may give extra warranty but may not on faulty charger and probably not to non original purchaser .

    Simplest quickest is to go out and buy a new charger .

    Yes, you're not likely to get anywhere with the seller, unless, as pointed out, they offered it with a warranty. Otherwise it is "sold as seen".

    However, it may be worth getting in touch with them to see if they still have proof of purchase, and seeing if the phone is still under warranty.

    Get in contact with Samsung, you don't need proof of purchase for the phone for a warranty repair.

    But as far as the OP is concerned that is the vendor .
    Other alternative warranty repair avenue is Samsung's limited 24 month warranty .

    And neither would the manufacturer be if no proof of purchase was shown to validate the warranty (and prove it wasn't stolen).
