    I'm not an expert so I would wait for other people to offer opinions as well, but the following clause would appear to entitle you to a full refund following delivery of the car. I'd be tempted to phone the company up again explaining that this is what you would do, with the expectation that at that point they'll then give you the full deposit back rather than pointlessly delivering the car to you only to take it straight back again.

    As nothing has been processed an admin fee should not be charged, raise a dispute with PayPal, get your moeny back, under DSR you have the right to cancel your order within 7 days, which you have done.

    Just to be clear, I didn't suggest that the OP actually did take delivery of the car, and certainly they shouldn't hand over any more money. Just to point out that this is what the contract terms state they could do when discussing the matter with the company concerned.

    That's incorrect.

    The rights to cancel under DSRs is excluded from personalised goods. Selecting a colour from a list of options wouldn't be personalised. Personalised would be if op requested a specific shade of x, for which they don't ordinarily sell!

    Note I said excluded from the rights to cancel and not excluded from DSRs - that's because some sections of the regulations still apply, irrespective of whether it's exempt of the rights to cancel.

    I too had a bad experience with buyacar!

    Their cars are Pre-registered to a middle company, so despite being assured by buyacar that I would be the first registered keeper I am clearly the second owner on the registration document. This I am sure is a common practice with this company.

    Buyers be aware of this!:j
  • By the way it was supposed to be a band new car that I ordered directly from the manufacturer!
  • Legally no contract can be binding for 7 days. (contract terms act) so tell them to refund your money and complain to paypal
