Parking Charge Notice (Smart Parking, Town & City Parking)

Hi,

I was wondering if there is anyone here that may be able to help me?

I am writing this on behalf of my mother who is 70 years of age.

She recently went to Asda at Havant and parked in the drop off / pick up zone without realising what the spaces were for.

She has a disabled badge which i am unsure if she displayed as she suffers from acute memory loss so can't remember if the badge was out :)

She went in to do her shopping and came out to find a PCN on her windscreen, inside was a till receipt style PCN.

There are no ANPR cameras and the sign where she parked only states that if you park in the spaces for longer than you should then you will get a PCN. There are no signs anywhere stating how long the waiting times are.

The contravention is for "Unauthorised Parking"

Are these ok to ignore or should i contact Asda or Smart Parking also trading as Town & City Parking and appeal?

    Get yourself down to the store and on her behalf insist THE Manager gets it cancelled.
    Failing that, ignore the thing.

    Complain of course, Asda can't let their agents harass disabled people. It's illegal. Why would you ignore that and feel you have to hide from the scam?

    Also - if the Asda Store Manager is useless - complain to Smart, not an appeal, a complaint, enclosing the Blue Badge and copy of receipt as proof that she was a customer and has a disability. You can also add that she has acute memory loss too and point out that her 'protected characteristics' mean she's covered by the Equality Act 2010. Copy in Asda Head Office Customer Service Dept.

    Appeal/complain in your name/address; I would, surely you don't want Mum getting the letters. Are you the registered keeper or is she?

    Take the till receipt and blue badge with you, don't be fobbed with its not our car park, that is a lie! Tell them that you know that their parent company Walmart owns the land as you've checked the land registry .

    Insist that you speak to the store manager, not customer services. And be assertive with this, take nothing less than an apology and a cancellation of this illegal fake ticket that controvenes the Equality Act 2010

    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Basically he was saying disabled people were not allowed to park there...

    It's direct discrimination then, because they are not making reasonable adjustments under the Equality Act 2010, you should do a little research on this so you can see what that covers, then draft an email to send to asda head office. Another tack is to embarrass them on their social media sites.

    I would do a big shop, with lot's of expensive fresh and frozen foods and other goods. Maybe £200-300 worth.

    Let them put it through the till and when it comes to pay, say sorry must dash, I'm about to get a unenforcable invoice from the scammers that occupy your car park and walk out.

    Well that may be the case in BASIC terms, as it's a drop off area, but the key points are that she didn't realise which is a feature of her disability. Therefore to pursue the matter now Asda are aware of her memory/cognitive disability is IMHO a breach of the Equality Act 2010. Direct discrimination, failure to make a reasonable adjustment.

    And Smart are not allowed to put fake PCNs on cars showing a Blue Badge (under the BPA CoP).

    So, now complain to Asda Head Office in writing, citing the above and again enclosing a copy of the Blue Badge. And send the same complaint to Smart parking as your first challenge. Give YOUR NAME AND ADDRESS, NOT HERS.

  • I have just returned again was fobbed off the manager is on holiday...

    It got quite heated and i told the deputy manager he wss useless... Made quite a scene in front of customers emphasising the fact that they were targeting a defenceless disabled old lady on a pension... My last words to the deputy after he said he has no feelings was you have no heart... I walked out...
