argos warranty and my rights

Looling at buying this chainsaw off argos

I have bough stuff from argos before and they told me they offer a 1 year warranty and if it brakes in the first 45 days they will replace or refund it but if its after the 45 days they said they would have to send it back to the manufacturer, which would mean you would be with out your saw
Having looked at 'the Sale of Goods Act' im not so sure as it says the seller has a duty to refund or replace the item not who they got if from
So Do Argos have to give me a refund or replacement is the saw is faulty?

Refund, replace or repair. Their choice, although they have to do it without causing too much inconvenience to the customer. There's no legally defined time period as to what would be reasonable, but with a non-essential item like a chainsaw I'd say 28 days would be reasonable.0

so basically what your saying is if it went wrong 9 month later they could say and they would be in there rights to say 'take it to the manufacturer, no refund or replacement at this shop!0 -
It is the retailer who has the choice, repair, refund or replace.
Obviously they are going to go for the cheapest first. If it isn't repairable, they can go to their next choice.make the most of it, we are only here for the weekend.

No. Under your statutory rights it is the retailers job to sort out the problem.
The Argos warranty is on top of your rights. What it says is:
- Up to 45 days they'll replace or refund
- After this time they'll send it off to the manufacturer
So in your first post you were right, there's a period you will be without the saw. However you will deal with Argos throughout, they in turn will deal with the manufacturer.0 -
So are you saying that by argos sending it back to the manufacturer they are dealing with the fault them selfs as a retailer0

I have just read the argos T&C and it quotes
We've made it easier!
If you bring it back to us within 30 days with your proof of purchase, we'll give you a
replacement or a refund.
If you've had the product for up to 1 year, we'll repair the product or, if that's not possible, give you a replacement or, if that's not possible, a refund.
Please note that all large kitchen appliances are excluded from our normal 30 day guarantee, but if your item develops a fault within 30 days, call us on 0845 640 0800 and one of our advisors will assist you with your problem. If faulty and if it cannot be repaired we will arrange a replacement free of charge or you can opt for a refund.
This does not affect your statutory rights.0 -

...and your point is?
It say's "we'll repair the product". That means they can and will send it off to the manufacturer.
They are dealing with it in accordance with your rights.British Ex-pat in British Columbia!0 -

Of course they are.
You can't possibly expect Argos to physically repair every item they sell themselves. They will arrange for the best person possible to effect the repair; in most cases this will be the manufacturer.
In any case, your only contact will be with Argos, they will deal with the manufacturer for you (unless you wish to chase them yourself)0 -
After 30 days Argos should have explained to you that the manafacture deal directly with you on behalf of Argos, once you contact them they will sort it out.
It probably would be the same outcome if they give you a head office to contact to sort it out, again they would just contact the manafactur to sort it out with you on there behalf, it'll just take longer.0
