    So you didn't bother to take our advice and get a POPLA code from Excel then? Wasted opportunity and Excel do sometimes try court! So this is too late now and not what we advised.

    Now you will be getting debt collector letters for months (which you must ignore) but you will need to watch out for any 'Letter before Claim' from Excel themselves as that will indicate they've picked your case for a small claim. Or real court papers from Northampton Court which would mean they have lodged a small claim which you would then have to go through the worry of defending.

    Why did you (presumably?) not respond to Excel when they presumably sent the usual drivel reply pretending that you have to name the driver? All you had to do was follow the usual advice as shown on all the other Excel threads and write back at the time and say 'not telling who was driving, give me a POPLA code or I will report you to the BPA and DVLA'.

    Too late now for POPLA, but you could report them to the BPA and DVLA if they faffed about without that POPLA code being given:

    What a shame you didn't come back when they must have replied to you - as you'd have won at POPLA by now. Instead you'll be hounded for months/years by this junk mail - and you will have to open each letter for years to check there is no court claim in the end (Excel have said they want to start issuing more small claims).

  • Hi...indeed I DID respond by letter to the Sheffield address, with a photocopy of my valid ticket, (thought I'd best hold on to my ticket) explaining what you suggested, and asking for a POPLA code as my intention was to pay for parking and that's what I did. I heard nothing and forgot about it until I received another from them. I didn't respond that time as they didn't have the courtesy to respond to my letter. (perhaps stupidly) Now this. I'm thinking now I should write a letter of complaint to the Peel Centre, esp if you advise ignoring this latest letter from Roxburghe. And report to BPA and DVLA. Appreciate your advice.

    Yes, if this were me I would complain about them - your best bet being the MD of the retail park if you have a receipt to prove you spent money there and if you tell them what you have said here, that you DID pay and display - but there was a typo in the car reg number you believe. Send the MD of the Peel Centre (whoever he is) a photocopy of the valid ticket and apologise for having to involve him because Excel haven't sorted it properly at all.

    Tell them that Excel have gone on public record as telling the BBC that they 'understand that people make these errors' and that Excel 'make manual checks' to ensure that tickets are not issued in these circumstances. But in your case the manual checks (LOL - I don't believe they exist at all!) have failed yet again - which you have seen from the bad online publicity about the Peel Centre is apparently a common occurrence - and Excel have also failed to respond to your appeal way back in May, proving that you did pay and display.

    The BBC article where Excel wriggled to protest too much that they apparently do these {imaginary?!!} 'manual checks' is linked here in a POPLA appeal:

    under the heading:

    'EXCEL FAILED TO UNDERTAKE THEIR USUAL MANUAL REVIEW OF TICKETS' {obviously don't copy the actual POPLA appeal wording or heading as such, but use the quote from the BBC article to your advantage}.

    So throw those facts at the MD of the Peel Centre, who we know does cancel these tickets as we have a successful thread confirming it just last month.

    I think what I would do is actually copy in Excel to the complaint you send to the MD, let them see what you have done and you could add a concluding line that if the fake PCN is not cancelled you will make an official complaint to the local Trading Standards about Excel's business practices at the Peel Centre, with a view to adding your unacceptable treatment and Excel's sharp practice to their file so they might investigate it further. And complaints will also be lodged with the DVLA and the BPA about their failures.

    Read around? IGNORED THE LETTERS? Excel have expressed an intention to issue more court claims en masse, yes, like Parking Eye are currently doing. And they have six years to do so. And yes they have started a few court cases, as have VCS (the sister company also owned by Simon Renshaw-Smith).

    Start your own thread for advice. :)

    Next time just search the forum for Excel and read current threads not 'reading around' on Google which throws up all sorts of OLD ADVICE.

    You and this poster and Elle here could have won at POPLA (in fact she's still in time to appeal but was about to IGNORE a letter, as she hadn't bothered to read other threads despite being urged to simply do a search):
