carphone warehouse

Hi I took out a contract phone from carphone warehouse for my daughter. A week into her having it she dropped it cracking the screen but it didnt affect the phone's functioning at all. A few months later the phone has stopped working i know its something to do with the memory. As it is still under guarentee I took it to the store it was then sent for repair. They won't fix it as it has a cracked screen they are saying this is why it's not working. I know this is not the case as I have heard that this particular phone has a problem with memory. I would just like to know what my rights are if I have any as I am paying for a phone that cannot be used.

    What *you know* is obviously insufficient. You have to prove it. If you are 100% sure, then get a written reply from CPW with their reasoning, then repair the phone elsewhere, get a report proving that your were right and sue CPW for the cost of repair and related costs via online small claims court.

    And, BTW, formally you are paying for the airtime that you can use with any phone, not for the phone that cannot be used.

    Thanks for the advice I will definately do that its more of a principal situation. They've made me so angry. Ive just been reading with this particular phone 100s had to be recalled because of this problem. They wanted £79 to fix it. Its a samsung galaxy ace.

    Be careful though.
    They may possibly argue that it can't be repaired without replacing the screen as the cracked screen doesn't allow them to disassemble the handset and then to assemble it back.

    You have no viable position. It doesn't matter what you've seen or read, abuse is proven - whether by dropping or water damage. The charge seems reasonable given that you'll be getting a working phone back with a new screen and a warranty on the memory.

    Don't shoot yourself in the foot on any 'principle' - that benefits nobody!

    Well said, I would be quite sure (even without looking it up) that the warranty will have a damage/abuse disclaimer.

    People need to stop taking contracts out for their daughters/sons when they know that they'll break it the next day. Especially the contracts bit where you're screwed by a big company for the next two years.

    OP- You can't do anything except pay to repair the phone or buy a new phone. (you can get the Ace for £80 today anyway, although i'd suggest different phone)

    Physical damage is physical damage and not covered by the warranty. What Buzby said is correct.

    I got a Samsung Galaxy Ace for Christmas but have only started using it properly the past few weeks and am using it on PAYG. The only things I've added are Facebook and email. I only have about 40 photos on it, and very few text messages. I have emptied caches, etc. but still get a message about low internal memory, and was annoyed that this meant I couldn't receive texts. I went into Carphone Warehouse this week and was told this was a common problem with these phones but that their Geek Squad could fix it for a charge (as I don't have their insurance). So I was very interested to find this thread. I don't see why I should pay the Geek Squad when it must be a problem with the phone and it is under warranty. If these phones have been recalled does this mean mine should be too? Any advice appreciated. :(

    The phone has 158MB of personal storage, so more than just 40 photos (unless they are very large files shot on something like a DSLR).

    Have you considered moving your personal stuff to the memory card and then doing a factory reset to correct any possible memory errors?

    At a guess, I would say that you might not be closing apps down properly when you're finished using them. This will most certainly eat into the available RAM - causing the phone to slow down, when you're trying to do anything etc.
    A low amount of RAM has always been an issue with cheaper phones.

    Try holding your 'home' button down, and this should bring up the apps that you have used and are still open and running in the background. You should be able to close them by swiping them off the screen. If you do this every now and again - you'll be amazed how much available space you free up and how much quicker the phone responds.
