    Just called TMobile customer services. Mentioned the RPI details above and intention to exit without penalty. Surprisingly was offered the chance to switch to a new tarriff to avoid paying more, without any extension to my contract? Declined their kind offer, as they do not accept they are wrong, and I would rather they are hit with the cost of a CISAS complaint fee. I am going to ensure my complaint costs them much, much more than any benefit derived from my price rise.

    One of the major issues with this whole affair is the fact that T-Mobile are changing their story to try and get out of admitting they got it wrong, and importantly the fact that they seem to think they have the right to tell their customers they can't go to CISAS which to my mind is completely wrong and OFCOM need to come down hard on T-Mobile 's obvious contempt for them, and the way in which they think they can treat their customers.

    had a load or argie bargie with O2 on the same subject. they've stuck to their guns on the RPI rule even though its now becoming apparrent that all networks got it wrong and they've breached their own rules.

    its going to be interesting how this pans out as i complained back in Feb about it. they took long enough to reply and still rejected my claim.

    this has done a lot of damage to the big networks. i for one will not go and use any of the big ones ever again because of the damage to customer confidence it has caused.
  • It appears that these early cancellation charges are a punitive measure built in to the contract. Punitive charges are not awarded by courts for breach of contract so the phone companies have awarded themselves!
    I would like to see these charges tested in court, to see whether the contracts are legal under contract law and the unfair terms act.
    I refused to pay Talk Talk when they demanded an early withdrawal penalty. They threatened court but never followed up. That was two years ago. I would have been willing to challenge them.
    The same thing happened with Vodafone on a Blackberry contract and they have also been threatening court for a couple of years yet never following through, merely passing off the debt to their debt collectors who's letters I simply ignore.

    Its not a penalty though, its the remainder of the contract your paying. Usually worked out as:

    Months Remaining X Monthly Line Rental - 20% VAT = Early Exit Fee

    My letter to TMobile has gone off today recorded delivery. Having received notification of the price increase on 9th April, I am within the 30 day period, and have registered my request to cancel (which was declined) both last night and this morning, 1 day before the price increase takes effect.

    To her credit, the person I spoke to this morning was very pleasant and helpful on the phone, and promised to call back. Predictably however with "Excruciating Experiences" this never materialised.

    I await their response with interest.

    This is the first time I see when someone is saying proudly that his credit history has been ruined by a default from debt collectors.

    At the risk of pointing out the elephant in the room, I suspect the change of ownership of this site, and the commission/revenue mobile phone companies pay to price comparison sites has had a bigger impact than one would realise. It's all about incorrectly priced Toblerones in Tesco these days. Shame really....
