    You should also bear in mind that they have a duty to mitigate their losses. There are two contracts here. You and Seatwave, and Seatwave and the buyer.

    If they were to truly mitigate their losses, then they simply refund the buyer and charge you just the admin. If they claim to source a more expensive ticket from elsewhere (which I believe they may well claim), then that is not mitigating their losses and you could sue to get your money back

    Thanks for all your help so far.

    I am still not 100% clear of the expenses I would have to pay...?!(excuse my ignorance!!! I am sure I will get there)

    Well, that's what SW would want you to do, but there is an ongoing discussion on whether the £25 is lawful or is it a penalty?
    Also, should SW be seeking out more expensive tickets, thus not keeping their losses to a minimum?
